h******a 发帖数: 157 | 1 My situation is a little bit complicated. I am a citizen and my wife is
working in China. She is not a citizen or green card holder. I will apply
green card for her next year. In this case, should I file our tax returns
jointly or just file mine only? The information I have heard is:
1) For tax purpose, we can file jointly or separately. If we file jointly,
we have to include her income in China as well. She already paid tax in
China, should she pay tax to U.S again?
2) Since i will apply green card for her next year, immigration office will
need check tax return for her? In this case, it's better to file returns
jointly?
My wife was in U.S before and she has SSN.
If anyone has similar experience, please share some information. Thanks! | f*******n 发帖数: 12623 | 2
Her income will have to be reported to the US, but she can probably not pay
tax on it by using the Foreign Earned Income Exclusion.
will
Your tax returns will be part of the Affidavit of Support which you need to
provide, and a jointly filed tax return can also be evidence of bona fide
marriage. They might wonder why a married couple would file separately (
which is usually worse than filing jointly). But if you have a legitimate
reason for filing separately, like her having foreign income and it's too
much hassle to treat her as resident and have to report her foreign income,
it should be fine.
