A federal lawsuit was filed against AOL Time Warner for allowing and not
condemning anti-Muslim hate speech, and sought class-action status for the
case (Weisman, 2001). The lawsuit was filed in August 2001, and charged
that the Dulles, Virginia-based company permitted anti-Muslim speech to
continue unabated in chat rooms catering to the Muslim demographic. This is
in violation of federal civil rights laws. The suit is based on the 1964

（1） The International Covenant on Civil and Political Rights (ICCPR)
states that "any advocacy of national, racial or religious hatred that
constitutes incitement to discrimination, hostility or violence shall be
prohibited by law". [1]
（2）The Convention on the Elimination of All Forms of Racial Discrimination
(ICERD) prohibits all incitement of racism.[2]

expression， which were contemplated by the framers and have been read into
the Constitution by the Supreme Court.
In 1942, Justice Frank Murphy summarized the case law: "There are certain
well-defined and limited classes of speech, the prevention and punishment of

include the lewd and obscene, the profane, the libelous and the insulting or
violent words – those which by their very utterances inflict injury or
tend to incite an immediate breach of the peace."[3]
