On July 6, Students for Concealed Carry Foundation (SCCF) filed suit against
Ohio State University, alleging OSU is infringing state laws meant to guard
the exercise of Second Amendment rights.
During a July 9 conference call, SCCF attorney Derek DeBrosse said:
Ohio's preemption statute says the state of the Ohio is the only body in
the state that can pass regulations that pertain to firearms. This statute
creates a uniform law throughout the state. Ohio State University is
punishing students and faculty for exercising their constitutional rights--
their 2nd Amendment rights--and the lawsuit addresses that.
He said the university is skirting Ohio's preemption law by using "the
student code of conduct" and similar codes to infringe the Second Amendment,
then claiming the "state administrative code" allows them to do so.
The Columbus Dispatch reports DeBrosse saying: "In a nutshell, the thrust of
this case was that the state of Ohio said, 'We're the only ones that can
regulate firearms.' What... [OSU has] done is a roundabout. Through the code
of student regulations, they've violated state law."
The goal of the suit is to require OSU to follow Ohio law on firearms. |
