Information is classified to prevent injury to the nation by its release or
publication. The three levels of classification (Confidential, Secret, and
Top Secret) correspond to the level of injury or damage the unauthorized
release might cause rated as Serious, Grave, and Exceptionally Grave in
ascending order.
The citizen's "right to know" is balanced with the government&#
39;s duty to protect. The fact that we are going to attack such and such at
0 dark hundred on the 30th may be information we as citizens would like to
know - but it's also information that would do serious damage to US
security and get people killed. So its classified.
When information is classified the classifying authority must set a date for
that information to be downgraded or declassified. Only the classifying
authority (organization) has the ability to downgrade or declassify
information. As the head of the Executive Branch the POTUS can declassify
information from Executive Branch agencies .. but not from Congress due to
the separation of powers doctrine.
Congress is in a bind in my opinion. They have a document that is based on a
compilation of information from various sources. Including that information
or a summary of it causes the memo to take on the same classification as
the source documents. That's why I believe they need the Executive
Branch's blessing to release it. |
