A drug patent lasts 20 years give or take.. This gives the inventors of the
drug time to capitalize on their drug and reap the rewards of their
innovations. Once their patent expires however, the drug is fair game.. This
allows generic companies to step in and produce the same drug, ultimately
reducing costs for consumers and making the drug cost-competitive. The
generic drugs must get approved by the FDA in order to start distribution.
What once was a well thought-out system has now been gamed by pharma
companies to an unfair degree.
1. Pay-for-delay agreemnets: Pharmaceutical companies will pay cash sums to
generic companies in agreement to delay the production and distribution of
these drugs so they can extend the time they have to monopolize the drug.
2. Citizen petitions: These petitions ask the FDA to delay action on a
generic drug application from being approved. By law, the FDA is required to
prioritize these petitions.. However, the citizens filing concerns are not
individuals but rather corporations. Branded drug manufacturers submitted 92
% of all citizen petitions near the date of the patent expiration, further
delaying competition for their drug.
3. Authorized generics: The first generic company to market a drug gets an
exclusivity period of 6 months. The company with the expiring patent is not
barred from launching its own "authorized generic." By selling a drug they'
re already making under a different name, companies can effectively extend
their monopoly an additional 6 months.
4. Restrict access to samples: Pharmaceutical companies will restrict access
to samples for generic manufactures testing needs. The generic drug makers
need to be able to purchase a sample of brand-name product to conduct
bioequivalence testing in order to prove they can make a bioequivalent
product following the CGMP standard.
The Risk Evaluation and Mitigation Strategies Program gives access to
patients who will benefit from these personalized medicine and bar access
for patients who won't benefit and could be seriously harmed. Brand drug
makers cite these requirements for the sole purpose of keeping generics from
coming to the market in order to decline the sale of samples to generic
manufacturers.
5. Generic drug makers are shooting themselves in the foot. In 2015, there
were 267 recalls of generic drug products for quality issues such as
products not dissolving properly, becoming contaminated, or even being
counterfeits. A few high-profile recalls have shaken the belief that generic
drugs are truly the same as their branded parents. A generic version of
Lipitor caused the FDA to launch a $20 million initiative to test generic
products to ensure they are truly therapeutically equivalent. The quality
control mistakes of certain generic drug makers in the past have cost
medicare and medicaid billions.
Pharmaceutical firms are currently using a set of tactics to make their
temporary monopolies semi-permanent. The US needs bipartisan support to
create measures to close these loopholes.

，并没有行业保护壁垒。当然现在的最主要问题是新药研发费用都由美国人买单。别的
国家坐享。新药在别的国家价格比美国低很多。美国应该立法新药必须全球价格一致，
专利失效后别的国家要仿制和使用也必须承担相应的研发费用份额，这样才可以把新药
价格降下来。

个公开指出实质要害的候选人了。不过我个人感觉有点太激进，对竞选是否有利还未可
知。毕竟这是断人钱财，算是和制药业彻底杠上了。
这篇文章里调查了从2010到2016的所有上市新药，都是从NIH资助研究里产生的。风险
和前期投资政府出了，巨额利润药厂拿了。而且拿了后不干好事：
