not usually consider new witnesses or new evidence. Appeals in either civil
or criminal cases are usually based on arguments that there were errors in
the trial’s procedure or errors in the judge's interpretation of the law.

应该不是你说的这样。所有上诉法院，包括高院，都不接受新证据，不管它是何时发现
的。我仔细看了一下新闻报道，发现原告 file 这个新证据的原因，是因为它推翻了之
前的另一个 sworn testimony！也就是说，原告必须让高院法官知道：嘿，你们做决定
时，不能根据那谁谁谁的证词，那是不正确的，否则会做出错误决定！
这是一个特例。普通原则是没有错的：巡回法院与最高法院，不接受新证据；要把新证
据加进去，那就是重审，从地方法院再来过。

（至于那个被推翻的证词，是否构成伪证？恐怕还要看是否故意。）
