WASHINGTON—The Supreme Court upheld Arizona voting regulations against a
Democratic challenge, overturning an appeals court ruling that found the
state’s restrictions discriminated against minority voters.
The court, in a 6-3 opinion by Justice Samuel Alito that divided the court
along ideological lines, ruled Arizona was on solid legal ground in
enforcing rules that prohibit third parties from collecting mail-in ballots
and disallow votes cast in the wrong precinct.
Democrats argued there were historical and societal reasons why the measures
discriminated against the state’s Native American, Latino and Black voters.

Arizona Republican Attorney General Mark Brnovich and the state Republican
Party defended the rules as neutral and reasonable measures for running a
fair and secure election.
The ballot-collection issue has been a source of partisan battles.
Republicans describe third-party collection practices as ballot harvesting
and say they are ripe for fraud. Democrats say some voters need the help
because they don’t have easy access to polling places or reliable mail
service.
The case had been closely watched because it gave the Supreme Court an
opportunity to interpret a key provision of the Voting Rights Act that
prohibits states from imposing any rule “which results in a denial or
abridgment” of the right to vote on the basis of race. Last week, the U.S.
sued the state of Georgia, alleging its new voting law aims to restrict the
rights of Black voters.
The Justice Department under the Trump administration filed a brief in
support of Arizona. After President Biden took office, the department sent
the court a letter in February saying the new administration disagreed with
the Trump administration’s interpretation of the law but not with its
conclusion that the Arizona rules were valid.
