In order to get the 17 month OPT extension, the employer
must qualify under E-Verify. Many companies do not.
Regardless of this, you should have 12 months of OPT unless
you previously already completed a master's in the US and
already used up the 12 months of post-master's OPT.

You are not understanding what the lawyer wrote.
The lawyer's note is correct. To elaborate:
1. You can apply for FY2011 H-1B on 2010/04/01. If
approved, you can begin working on 2010/10/01.
