I'd suggest not to come unless you are prepared to wait, the waiting could
be several weeks if got checked.
and the border is now very strict that once your old visa (even if expired)
is 'cancelled without prejudice' by
the consulate, you will not be allowed to go back to US, but have to wait in
Mexico.

after reading your message.
By the way, are you waiting for your visa to be approved in Mexico or US now?
When was your last time to go back to China?
When your old H1b will be expired?

scary
it is indeed very troublesome if one gets checked and will be stuck in
Mexico. The options you have:
1. Go back to China to wait, and then come back to Mexico to get the visa
stamp once it's passed, but too
much trouble finding the flight, plus, you will need Mexican visa to come
back, plus the uncertainty of when
it's going to be ready, and TJ is far from other Mexican cities with flight
to China;
2. Wait here in Mexico.
3. Try to cross the border: this could be dangerous if you don't have valid
visa according to lawyers, they
can reject you at the border and keep you out of US for 5 years. If one has
valid I-94 (the white card), and
old visa (even if expired), then the border officers may allow you to get
back, but once you go to consulate
for visa application, they will put 'Cancel without Prejudice' on all your
previous visa stamps, no matter they
are valid or expired. Nowadays, seems the TJ border is very strict with the
rules.

发帖数: 33 | 6 I was lucky that the TJ consulate was nice enough to consider my family
emergency, and requested
expedite process for me.
I got notice this noon, that my visa was approved, turned in my passport
right away, got my visa stamp at
4pm. Then back to San Diego airport before 6pm, and back home same night.
I was also the only Chinese for visa application on 12/22/10. Two weeks
waiting for check is probably the
shortest I've heard. An Indian friend renewing his H1B for same job at same
company went to TJ before
Thanksgiving, and this is his 6th week waiting, still no news yet.
My feeling is that for H1B, if you are in relatively 'sensitive' technology
area, such as EE background,
semiconductor, laser, etc, very easy to get checked. And you will be stuck
in Mexico for a long time. So
going back to China is still what I'd suggest.
