letter to see if you belong to exempt or non-exempt category to decide whether
you are entitled to the overtime pay.
Most jobs in the United States are governed by the Fair Labor Standards Act
(FLSA), which establishes minimum wage and overtime pay regulations and
other employment laws. Some jobs, however, are considered exempt from
overtime rules. Very complicated requirements for exemption are outlined in
the FLSA Regulations.
OVERTIME:
Under the FLSA, nonexempt workers are entitled to 1 1/2 times their regular
rate of pay for each hour worked over the applicable threshold, typically 40
hours per week. Exempt employees are not paid extra for working overtime.
