正在申请3 Year H1 renewal.
最近一个大公司要给我offer,我也想接这个offer.
想请教一下各位大侠，
象这种情况是不是一定要明年10月以后才可以上班（我记的前几年是）？
有没有可能明年4月1号以后上班？
现在非常头痛怎么和用人单位说，在此请教了。

It is a gray area if you start on 4/1, check with the company's lawyer. If
the lawyer says yes, then just move on. Also, your PD could be current in a
couple of months...

I am a lazy guy. My NIW filed on 2011/June before the last day of my 5th H1
so I don't think my PD could be current soon.
That company can sponsor me Eb2 green card applicatin within 2-3 months so I
don't care green card very much at least now.
Based on your information, I have to persuade them to wait me for 9 months
then.
One question, is O1 visa possible? Does O1 has quota limitation?

发帖数: 319 | 4 O1 is definitely the best choice for you, no quota, no time limit. It
almost equals to EB1B. Go for it if you can.
If O1, do PP, make sure you get O1 approved before you quit your current
position. Then EB1B after O1...

不过，你说的话有点颠覆了我目前的认识。 ：）

比如说，为什么4/1号开始就能上班【假定4月1开始新单位替我开始申请工业H1]，
其次，为什么一旦批下来，就要停止工作等到10月1号？从批下那一天【假定9月一号】

发帖数: 8496 | 8 ICE has clear rules about F1 cap-gap. As for cap-gap for H1 non-cap to H1
cap, USCIS current interpretation is what double fish says. During April 1
and Sep 30, if H1 transfer from non-cap to cap is filed, portability is good
during H1 transfer is pending, and portability stops when H1 is approved
before Oct 1. |
