The distinction between final and interlocutory orders is an important one,
particularly when it comes to determining which is the correct route of
appeal under ss.6,17,and 19 of the CJA. This is often a difficult matter to
ascertain, and cases continue to go to court for a determination as to
whether the order in question was final or interlocutory. In this area,
perhaps more than any other area of civil procedure, reference to decided
cases is indispensable.
An order is considered to be final if it finally disposes of the plaintiff's
or applicant's entire claim or an important issue in the overall dispute
between the parties. If it does not do so, it is considered to be
