given waivers by three state regulators that would allow it to keep selling
coverage if it misses a capital target, and has so far has been denied
approval by one state, Chief Financial Officer Bob Quint said Tuesday.
Radian is still waiting to hear from an additional 11 states that measure
capital at the company's main mortgage-insurance subsidiary using a metric
called the risk-to-capital ratio.
The waivers would allow Radian to keep selling coverage if its main
subsidiary exceeded a risk-to-capital ratio of 25-to-1. The need for the
waivers increased after the company warned earlier this month it will need
to take a charge in the fourth quarter that would have pushed the ratio to
as much as 24.2-to-1 had it been taken in the third.
In addition, Radian is working with its main customers, Fannie Mae (FNMA)
and Freddie Mac (FMCC), to gain approval to begin selling coverage in all 50
U.S. states from another separately capitalized subsidiary.
Radian's effort to keep selling new coverage is essential to its survival.
Coverage it sold in recent years has so far proven to be highly profitable,
but those profits haven't been enough to offset still-mounting losses on
policies sold before the housing bubble burst. Radian and other mortgage
insurers that are still open for business hope regulators will give them
enough time to dig their way out instead of shutting them down.
"The regulators clearly understand that our writing new profitable business
is better for them in terms of their desire to support the policyholders,"
Quint said in a presentation to investors Tuesday. "Having the flexibility
to write above 25-to-1--even if it's 30-to-1 or 35-to-1, hypothetically--
gives us more flexibility and the ability to get through this period until
we turn the operating results around."
State insurance regulators have granted waivers to rivals MGIC Investment
Corp. (MTG) and Genworth Financial Inc. (GNW). But they have forced another
insurer, Old Republic International Corp. (ORI) to halt new sales of
mortgage insurance, and taken over subsidiaries of another insurer, PMI
Group Inc. (PPMIQ). PMI declared bankruptcy last week after a judge rejected
its attempt to overturn the seizure by its primary state regulator in
Arizona.
For Radian, insurance regulators in several states are looking to
Pennsylvania, which is the company's primary regulator. Pennsylvania isn't
among states that require waivers to keep selling coverage above the 25-to-1
capital ratio. Quint didn't disclose which states Radian received capital
wavers from or which state turned the company down.
Before regulators in other states make a decision on a waiver, they will "
discuss our situation with Pennsylvania and get comfortable that
Pennsylvania is providing the right oversight and are comfortable with us,"
Quint said. "Clearly, the projections are going to have to show that
although we may go above 25-to-1 temporarily, that ultimately we come back
down below that."
Quint said Radian and the other mortgage insurers had substantially improved
their underwriting standards since 2009 and had begun taking market share
from the U.S. government's Federal Housing Administration in recent quarters
. The FHA has raised prices as it deals with a potential shortfall of its
own.
"There are loans that we will never write again--period," Quint said. Among
them: loans to subprime borrowers that Radian now believes "can't be priced,
" and so-called Alt-A loans that didn't meet standard documentation
requirement and "ended up being a disaster in this economy." |
