Your Re-presentation:
Sunday, December 25, 2011 The buyer ordered HP TouchPad Wi-Fi 32 GB 9.7-
Inch Tablet Computer from me on November 30. This product is not an android
tablet. My description did NOT state it is an android tablet, either. The
buyer must have known this before he placed the order. I sent him the right
product, which was the same as what he ordered and as what I described.
Before the buyer requested the return, he contacted me saying that he could
not turned on the tablet. I have emailed him quite a few times to help him
by providing some suggestions to make it work. I also admitted to accept
return without his cost if he still had problem in turning it on. I even
sent him a pre-paid label for him to return. But I also told him that if I
found the returned item is working and does not have the problem as he
stated, I will charge him 15% restocking fee and shipping fee. After quite a
few days, he did not return it to me by the required date. Instead, he just
requested returning the item with the reason 'Different from what was
ordered' and the comments 'i wanted an android device the HP is very hard to
navigate'. I emailed him the same return policy as I told him previously.
He replied saying 'I finally got the volume to work', so the touchpad
actually works well and does not have any problem. Now he opened this A-z
claim saying 'that the tablet is not holding a charge and had other problems
with the volume'. The buyer is surely lying. The item I sent to him is
brand new factory sealed and it must have a new charger. Actually he used
the charger to charge the touchpad, as his first email stated. He also told
me 'I finally got the volume to work'. What are 'other problems'??? Actually
no problems at all. Judging from what we have communicated, the item I sent
to him was truly as described, was the right item as he ordered, and was
working (not defective). The buyer just used it for a couple of weeks and
did not like it, so he wanted to return it. Obviously, he is trying to find
some ARBITRARY and FICTIONAL excuses to return the product, which is very
unfair, unreasonable and unacceptable. As I told him, if the item is not
defective, I would not accept return because he already opened and used it.
If I take it back, it will affect my reselling it significantly. On the
other hand, in almost all US retailer stores, a customer cannot return any
non-effective computers or tablets after 14 days from purchase date, no
matter whether the customer has opened it or not. This buyer requested
return on December 16, which was the 16th day from his order date. And he is
returning a working non-defective item that was factory sealed but opened
by him just because he did not like it after trial use. He is trying to
abuse Amazon's return policy to make unreasonable and unfair return. In one
word, the product I sent to him is as described, is the right product he
ordered, is working well. I will not accept unfair and unreasonable return
because of the buyer's FICTIONAL excuse.
