个吗？
我们小公司几年时间只有一个patent 和一篇paper。够吗？主要的research都是的
applied on production.

本想等我弄完I-485后再来折腾这些东西的。但这两天收到好多来自申友的、要求给材料的短信，也能体会到大家与我当时一样的心情。所以，就先把letter templates整理下下，并更新在这个贴子后面了。有留下email地址的申友，我已把letter templates发到你的信箱里，请查收。至于还未留email地址，就请不要再给我留email地址了，直接在本贴后面拷就是了。（当然，如果是想给俺包子的话，俺是会张大口袋接的 ---- 俺也想ZAN点儿，等GC到手后，发几个给曾经帮助过我的前辈们，：）

,心里很没底,现在被RFE了,心里更加没底.眼看还有2周就到了回复的期限, 有点焦虑,
心想自己在那里 鼓捣的也不知道对不对,不如上来请教一下看看各位老师的意见. 如果
这次RFE过了,一定上来写个详细的经验来答谢大家.
先简单介绍一下背景, 不强,大家别见笑.
三流美国学校的生物学PH.D., PH.D期间发了7篇文章, 4篇是第一作者.但是IF都不高,
都在4~5 左右或更低.
现在在一所还过得去的大学当博后, 研究的方向和读书期间完全不同. 2年间发了一个
第一作者,一个第三作者. 第三作者的那个文章分量稍重一些，一年里有12个引用.第一
作者的那篇一般,因为是今年6月才发的, 目前还没有引用.
所有的文章加起来引用有40 次. 没有得奖. 只有AACR 的会员.
可能是我第一次递交140写petition letter的时候太马虎，没有好好把事实陈述清楚，
（现在回头再看自己也觉得太乱，没有重点， 很后悔第一次交的时候没有好好对待，
没有直接据我就该庆幸了）

发现IO是著名的杀手XM399。
RFE要求下面3条，请大家帮忙参考一下：
1. Request for Translation. 明明我的所有中文材料都有翻译，IO 还是要翻译。这
种该怎么回呢？直接指出原来的package都有翻译会不会引起反感？还是把所有的中文
材料重新翻译一下？

这条，我现在的公司没有专利，文章或者什么research report的，不知道怎么办。会
不会因为这点被拒啊？这样会不会认为公司不qualify。公司有Eb1b办成的先例，PL里
面根本没提这些。
正在联系律师，律师说要$1500帮我搞这个RFE，我在犹豫中，请大家赐教。
到这个关头了，不想前功尽弃，大家觉得我需要请律师搞定公司的qualification吗？这
点严重吗？

documented accomplishments in the research field，那我想他的担忧是有道理的。
USCIS的确要求了1B的公司必须有三个以上full time researchers，且公司需要有长期
的documented accomplishments in research. 这些可以通过公司几年来发的paper，
file的patent来证明，如果没有这些内容，1B比较困难。1B对于公司的资质的确存在一
定的门槛，如果你找不到这些材料，那我觉得你律师在这部分说的有道理。但是说你的
position会牵涉到product design就没资格申请1B，这种说法是错误的。

断申请人不够强所以拒绝的么。
我看了看判例里头Final Merits Determination 中扣得比较细（这个判例本身是3个标
准中通过两个，拒绝一个的，但是在Final Determination里头有很细节的描述），要
求也很高。比如“However, the accomplishments of the petitioner fall far
short
of establishing that he "is one of that small percentage who have risen to
the very top of the field of endeavor" and that he "has sustained national
or international acclaim and that his or her achievements have been

process and they nearly screwed it up. They all tend to be american law
firms and they generally have less experience dealing with EB1 category,
whereas a majority of cases handled by the chinese law firms (or firms
consist of primarily chinese lawyers) are in the Eb1 category.
Your case sounds strong, good enough for EB1A, which may be an alternative

前几天HR说开始办EB1B，先让指定律师评估。HR对律师的一个问题有疑虑."has at

research field"。 HR说不确定公司满足"documented accomplishments in the
research field". 公司只有两年历史，目前没有assigned patents也没发表过文章，
不知道该怎么提供证据。
一直没有EB1A觉得想EB1B容易些，结果公司的条件可能不满足。不知道版上的有没有人
经历过类似情况吗？
第二个问题就是如果办EB1A,还缺啥条件，有没有靠铺的律师推荐？ |
