线写china tax treaty artial 19,这样你就能拿additional child tax credit了.

我的理解是，我这种情况就是工资乘以统一税率，基本不会发生税额不够，
在state income tax W-4表里的additional amount you want deducted from each
pay (if employer agrees) 填个0就可以。

2011年是J1第三年，只被扣了FICA，老婆和孩子（非美国出生）全年都和我呆在美国。
老婆没有工作没有收入没有SSN，现在准备为老婆和孩子申请INIT而且married filling
jointly填1040表.但是孩子显然不符合child tax credit,所以只能试着申请
additional child tax credit.按照1040 instruction 第41页最下面TIP,又必须先填
写EIC，接着参照1040 instruction 第45页"the child must have a valid SSN.....
otherwise, you cannot take the credit" .那岂不是我的孩子根本就不能得到任何
credit啦？还是我在哪一步操作错了？求各位赐教。再次感谢。 |

拿earned income credit
但additional child credit似乎没有这个要求？填一下1040的Child Tax Credit

在J1第三年，2012年免联邦税，2012年小孩出生，现在我们想filing federal tax
jointly。 想请问一下：
1. 2012 年我们都是resident, 所以可以filing federal tax jointly，然后claim
one quilifying child，这个没有问题吧？
2。 除去我们俩免税的收入， AGI 大概20000左右， 再减去standard deduction
11900, 再减去 exemptions 3800*3,这是对的吗？ 那算下来 AGI 已经不用交税了
3，接下来的问题就是我们的child tax credit 没有用上，所以在line 65 还可以
claim additional child credit 1000。可是这样的问题在于 我交了5000的税（包含1
-7月本应免税的部分），这样算下来我不仅可以把这5000要回来，还可以多要1000回来
，这样合理吗？ 还是我哪里算错了？

因为我通过了substantial presence，2013年作为resident alien保税。我的收入是RA
，有fed和state的withholding；我爱人全年的收入是nontaxable fellowship，没有任
何tax withholding,没有W2表。我们是married jointly。请问：
1. 我爱人还能把5000的treaty加进去吗？还是只能我自己一个人满足 5000？这个是算
成负数填在line21 other income里吧。
2. fellowship要不要加到 1040 line7的wage 里？因为这个会影响EIC的算法。这个我
一直不明白，是不加上好，还是先加上然后在line21 other income填上负数减去？
3. 因为taxable收入低，加上claim一部分education credit，最后的tax数很可能接近
于0了。如果能拿到EIC，还能申请additional child credit吗？我不明白2者的关系。

Schedule 8812 Part I仅针对没有ssn而有itin的小孩。对于有ssn的小孩不用填。

你自己把Child Tax Credit Worksheet和Schedule 8812全部走一遍就行，内容不是很
多。
Additional Child Tax Credit是refundable的，而Child Tax Credit是non-
refundable。non-refundable是指把你该交的税抵到0，不会倒贴给你钱；refundable
是即使你不用交税，还可以倒贴给你钱。 |

刚刚收到SR回复如下，麻烦请教大家，这种情况真的还要等很久吗？有没有什么办法再
催催？因为9月9号本来要回国开会，副申请人现在用J2 EAD工作，所以她新的EAD下来
前我不敢回。十分感谢。
