很奇怪,就到网上查了一下,原来Affirmative Action的中文翻译果然是“平权法案”
!这些年来中文媒体的东西看得少了,连这个都不知道:(
可是这样翻译实在是太颠倒是非了吧。。。中国人莫非已经习惯于混淆视听?还查到美
国旧金山有个华人组织叫做CHINESE FOR AFFIRMATIVE ACTION,中文是“華人權益促進
會”,促进的是谁的权益?
港台那边好像也是主要使用这种错误的翻译;偶尔见到稍好的:“(種族)優惠措施”
,或“矯正性命令”。
俺不懂日文,在google搜索日语网页看到这样的翻译:“積極的優遇[差別撤廃]措置”
或“積極的差別是正措置”,有的词条注解也点明“逆差別”。根据英文对照,上面的
“差别”就是“歧视”的意思;“是正”就是“矫正”。还有一个译法是“肯定的措置
”,不如上两个。
Affirmative有“积极”的含义,Affirmative Action的实质就是为了纠正歧视而优待
,所以翻译成“积极优惠措施”比较妥当。可惜俺人微言轻,以后只好继续被中文媒体 |

我家孩子也被哈佛拒了,但我仍然捍卫AA》。读完之后我提交了一段留言,但不知何故
始终没有出现在留言区。这给了我一些激励让我在留言的基础上详细扩展成这篇文章作

1什么是肯定性行动(Affirmative Action)
Affirmative Action(以下简称AA)最早的使用是在1961年肯尼迪总统的第10925号总
统令,其内容主要包含两点,第一是要求政府不得以种族,信仰,肤色和起源国为由歧
视雇员和申请人,第二是采取肯定性行动以确保政府雇员和政府工作申请人在过程中不
受到以种族,信仰,肤色和起源国为由的歧视。1965年约翰逊总统发布了取代10925号
总统令的11246号总统令,并重申了上述内容。1967年的第11375号总统令把“性别”也
加入了受保护类别。

对的不是黑人,而是白人。
Affirmative action起因是为了照顾黑人。这个有情可原,毕竟历史上黑人受到过很不
公正的待遇。而且黑人民权运动不能不说是造福了各种有色人种的。
就说Affirmative action,本意也不是歧视华人,而是照顾少数民族。但是具体实施起
来就大有猫腻了。比如本来是应该照顾学习上不行的少数民族,而没说限制太优秀的少
数民族。这个立足点是对少数民族的一点照顾不会很冲击最为多数的白人的利益。结果
被当权者给执行成了按种族划分名额。这个显然是针对亚裔的。现实的结果就是AA极大
地伤害了亚裔的利益,而实际上对白人的利益是起保护作用的,因为如果没有AA限制亚
裔,那即使不照顾黑人,白人上大学的机会也不是增加,而是减少。实际上美国反对
Affirmative action的声音也是有些白人以为AA牺牲的是他们。实际上部分州取消AA的
结果是白人上大学非但没变容易,反而难了。如果白人明白这一点那绝对不会反对AA的。

1.白人是在用牺牲亚裔来补偿黑人。白人没有牺牲自己。
白人要补偿黑人我没有意见。但是不能以牺牲亚裔的利益来实现。
刚才在本版看了一个帖子,说aa实际上是把亚裔的位置让给了黑人(取消aa,白人入学
等比率几乎不变,会大量增加亚裔入学)。
白人祖先犯了罪,为什么要亚裔还债?道理何在?
2.affirmative action是对黑人的歧视
实际上是认为他们没有足够的能力与其他人种竞争。aa打击的是黑人心底的自尊和自豪感self-esteem.
3.affirmative action违反美国宪法
美国宪法禁止以肤色种族为标准来判断一个人。aa正是以肤色种族来判断一个人是否符
合录取条件。
4.affirmative action违背了Martin Luther King的理想
mlk的理想是人不被肤色来判断。mlk如果活着也会反对aa的,因为这与他的理想正相反。之所以单提出他来,因为他是美国黑人的追求平等的代表。

affirmative action违宪了。最高法院几十年前裁定AA作为一种race conscious
remedy是符合美国宪法的。
Race conscious remedy最早的出现是为了执行Brown v. Board of Education的
desegregate school并建立种族融合的学校的精神,所以AA的前身是affirmative
integration。 Brown案子大家应该都听说过,它实际上是两个部分,1954的第一部分
只判定了separate but equal 的教育系统违反了宪法中的equal protection,然后最
高法院在1955年裁决的第二部分里开始要求全国学区以最快的速度desegregate and
integrate。对于有些地区实行的affirmative integration,最高院在1971年的Swann
v. Charlotte Board of Education中判定这种方式是合法的,而且阐明学校have

top US universities complained about they are seeing too many Asians on

3012是严重的政治路线错误。
众院主席Lamar7月11号已经明确表明2012年因为时间有限,不会再处理任何移民法案。

we are an affirmative action employer.
equal opportunity指的是, 不管申请者的年龄性别和种族,都获得一视同仁的对待.
affirmative action指的是,优先录用黑人,墨西哥人,LGBT, 女性等. 在这个
affirmative action的录用优先顺序里, 华裔男子排名倒数第一,是最后一个被录用的,
华裔女子享受到对女人的照顾,所以是倒数第二被录用的, 比华女低的,只有一群人: 华

其实没完全推翻,只是限制了一下现在法院对大学的放任
背景说一下:德州大学奥斯汀分校(其实是总校好不好)在收录学生的时候把种族当作
考虑因素之一,某白人MM被拒不爽,于是状告学校录取学生的做法种族歧视。
初级法院在案子没有上庭之前判定MM败诉(Summary Judgment)。
MM上诉,上诉法院维持原判,说根据以前最高法院的判决,虽然任何与种族歧视的政府
措施都要以所谓“严格审查”的标准来断定其合(宪)法性,但在教育问题上,因为
student diversity是一个正当而且非常重要的政府目标(legitimate and compelling
state interest),法院会尊重大学自己来掌握分寸;除非学生能证明学校的作为不正
