我是房东，一个黑人大妈房客一天突然打电话给我说
下雪天她在门口滑到，叫了救护车，正在医院急诊。
后来她就出院了，其实医生检查上说了没有摔断什么，
就给了一些最基本的止疼片。结果从此这个房客就缠上我，
她经常去看therapist, 然后装得走路困难。最后要我
赔偿我一看医疗账单一长串啊。我就打电话找了保险公司。
开始我也和楼主一样害怕。保险公司联系了assessor，
这个人非常有经验。他来调查了几次，然后告诉我不要和这
个黑人接触。有什么事儿都让她找保险公司。我问他我是
不是应该找个律师，他说目前不用，这种案子1%最后才会丄庭，
到丄庭再请律师也来得及。在此之前保险公司会去和她的
律师交涉的。这事儿拖了大半年，最后我收到这个
assessor的消息，说保险公司赔偿她1000刀了事，让她
签署了一个我方无责任她不得继续追索的paper。这件事
就再也不能拿出来说事儿了。
我的经验是，保险公司不会愿意这么轻松给她钱的。她可以狮子
大开口，但是最后保险公司的律师啥的也不是吃素的，比
楼主自己请的律师往往更有经验。所以这事儿就盯住保险公司

出了一个车祸，我认为是对方的错。警察要我签一个citation.当时就不满，问可不可
以不签。他说you either sign this or go to jail and signing this doesn't mean
you plea guilty. 介于当时ambulance 就要出发，就签了。他这样做是不是违规威胁
啊？

也停下了。然后几秒钟的时间我就听见一个金属的撞击声音，我前面的车就往路肩挪，
我还没反映过来怎么回事，然后就一声闷响，我的车就被从后面撞了。车后盖被撞开，
后备箱也烂掉。后来警察来了，情况是involved 4辆车。No.1车没停撞上前面的No.2车
，No.2车接着撞上他前面的No.3车，No.3然后撞上我的车No.4。我前面的车及时躲开，
啥事没有。
警察叫了救护车和拖车，然后说是No.1车的责任。我因为后背疼，就被救护车送去ER。
过程中有一个witness帮我们打了电话叫警察，我当时都蒙了，也没留她的信息。我被
急忙送到医院，所以都没有来得及问其他司机的信息。
这是我的第一次事故，现在想来根本是可以避免的。我前面的车挪开，我本就该跟着挪
到路肩或者往前开到他的位置没准都可以不被撞上。我当时甚至都没有看一眼后视镜-
sign，被撞上才知道。
我的车被警察叫的拖车拖走，然后拖车的司机推荐了一个body shop，说周一会把我的

和老公两地，所以只有一个人。走出一会，天开始下雨了，于是往回走。 在走到楼下
路口的时候，看到有辆车停在stop sign前面。 我见它不动，以为司机让我先过，所以
我就过马路。结果走到车前面的时候，车突然开动，把我撞了。下面示意图标出车的位
置，和我过马路的方向，碰撞位置是车左前bumper。幸好车速不快，我摔的时候下意识
保护了宝宝，手肘和膝盖擦破了皮。当时报了警做了记录，叫了ambulance，在医院住
了一晚，做了一晚上的胎心监护，宝宝一切都好，就出院了。
现在对方保险公司不肯pay我的bill。理由是在这起事故中，我也有责任 （

Bill是医院和ambulance寄过来的。我们确实没想过要对方怎么样，只要他们把因为这
一事故引起的医院的bill给付了就行了。我们找过律师，但是律师觉得case太小不愿意
接。我们也向学校的法律部门寻求帮助，结果那边的人说他们只负责speeding之类的
case。他们倒是说会帮我问问看有没有律师愿意接，后来也没有了下文。我们会继续找
律师，希望能有律师会接。我在北卡夏洛特，如果哪位有律师介绍，那就真是太感谢了。
如果真的没有律师肯接，那我会去小额法庭试试。我有个concern是对方用的是
contributory negligence，我查了一下，根据北卡的法律，只要我哪怕有一点责任，
他们都是可以deny我的claim的。也就是我我必须证明我一点责任都没有才行。

左转follow前车抢黄灯被对方过来的Chevrolet Malibu把我的Toyota RAV4给撞翻了。
我自己还OK。在家躺了几天能活动了。对方问题比较大，锁骨骨折，在医院手术。当时
都没上ambulance。
问题来了，除了事故才发现我赔对方受伤的只有30,000.肯定不够，这种情况接下来
会怎么处理？

这种行为叫做ambulance chaser，in-person solicitation，律师可以因此被吊
销执照，你可以向你所在州的Bar Association举报这个律师。在美国的所有50个州都
不允许这种行为出现。在某些州，例如Florida，甚至规定在出车祸的30天内严禁任何原
告律师与当事人联络。
你会遇到的问题是：这个律师并不一定有足够资格能够代表你获得最大赔偿，但如果你
同意这个律师代表你，拿到多少钱你很难再argue更多的赔偿。我建议你自己尽快做
medical examination，然后寻找一个适合你的有资格的律师。
大多数有稳定客户的律师都不会冒险这么做，我强烈不建议你找这种律师代表你的案子 |
