问，在appeal可以得到改变。
最大问题的是prosecutor. 是prosecutor和罪犯cut the deal 把murder II减为
Manslaughter, 显然也没有appeal.
我猜主要原因是prosecutor的boss是DA, DA是elected official or political
appointee. 民意是驱动DA和prosecutor的最大动力。这才是这个悲剧的主因。
所以这也是一个权利的问题。在prosecutor 出现之前，是victim自己或家属请lawyer
。为了救济穷人，保障公平，政府把这个个人的权利剥夺，用政府资源来做这件事。理
论上政府应该是公平无私的，但是在这个例子里面，我们看到政府的作用就像妓女，价

蛋糕店是私营企业。这次的雇主也是。
两个索马里难民是穆斯林。雇主Star Transport, an over-the-road trucking
company，在雇佣这两个穆斯林的时候，已经告知两人工作包括卡车送酒。
但是，这两人，以宗教信仰为由，拒绝运送啤酒。被裁是自然的事情。
但是，奥巴马政府下的EEOC，代表两人提告雇主Star Transport。以雇主必须保证雇员
的宗教信仰不受侵犯。赢了，雇主被罚$240,000。
明显，奥巴马政府针对穆斯林的保护，和针对基督教的严厉形成鲜明对比。很难让人不
对奥巴马的宗教信仰有想法。详见：

更甚者，这个宗教信仰的过度保护必然伤害经济。雇主的负担加重了。要么收摊，要么
加价消费者（你我）承担，把这个损失以及以后穆斯林不用送酒或者任何违背可兰经的
货物。
