A federal district judge has set a hearing for February in the lawsuit
challenging Texas’ bans on same-sex marriage.
Federal District Judge Orlando Garcia will hear arguments on the plaintiffs
’ motion seeking a preliminary injunction that would bar the state from
enforcing the bans pending a trial.
The plaintiffs — gay couple Mark Phariss and Victor Holmes of Plano, and
lesbian couple Cleopatra DeLeon and Nicole Dimetman of Austin — filed the
lawsuit in October alleging that the marriage bans violate the U.S.
Constitution. The motion for a preliminary injunction was filed in November.
The hearing will be at 9:30 a.m. on Feb. 12 at the John H. Wood, Jr. United
States Courthouse in San Antonio. Even if Garcia, a Bill Clinton appointee,
grants the motion, the decision could be immediately appealed to the 5th
Circuit U.S. Court of Appeals.
Defendants in the lawsuit include Gov. Rick Perry, Attorney General Greg
Abbott, Bexar County Clerk Gerard Rickhoff and David Lackey, commissioner of
the Texas Department of State Health Service.
Neel Lane, an attorney for the plaintiffs, discussed the motion for a
preliminary injunction in an interview with Lone Star Q last month.
“What we’re really hoping to do by filing the motion for preliminary
injunction is to expedite consideration of the plaintiffs’ claims,” Lane
said. “What we don’t want to do is have this go down a track where it
takes months or perhaps even years to get to a hearing, which can occur with
an ordinary piece of litigation. We don’t regard this as an ordinary piece
of litigation.
“In order to get relief, we have to show there’s a likelihood the
plaintiff will succeed on the merits of their claim, and we believe we made
that showing,” Lane said. “Having said that, it’s going to be fiercely
opposed and litigated by the state of Texas. I can’t really handicap the
odds of this motion. I do think ultimately, at the end of the day, these

其实德州虽然保守,Houston和Dallas那种大城市的local culture应该还是挺open的。
就连Luisiana这么穷乡僻壤之地,那个新奥尔良都crazy得不得了,上次我去新奥尔良
,看到他们主要的旅游点French Quarter满街都是彩虹旗,比LA还过分,LA也不过就是
只在同性恋聚居区有彩虹旗。所以啊,在保守州,就得走城市包围农村的路线。

的成绩了。比如加州吧,革命的烈火不过也就是从SF和LA这两个大城市燃烧起来的,内
陆加州靠近Nevada那边的山区本来也很保守的,可是加州支持同性婚姻的人口比率也是
逐年递增啊,这不就是城市包围农村吗?

城市本来就是进步文化的集中地,是社会发展的大趋势。
什么农村包围城市那都是老毛搞出来逆历史潮流而动的。
