康州发生如此人间惨剧，鄙人几日来心里不能平静。作为枪版老友，鄙人一直觉得禁枪
是不合理也不可行的。但是让赵承熙，滥杂这样的精神有问题的人，轻易得到威力巨大
的枪械，确实是严重的社会问题。所以经过深思熟虑，鄙人和Joe Manchin，
Scarborough得传统NRA会员一样，改变观点，开始支持加强对某些枪械的控制。
鄙人对枪械拥有使用多年，对各类枪械性能还是有一定的了解的。对美国的相关宪法条
文和法律也是熟悉的。深知禁枪在是不可能的，所以应该从控枪出发考虑问题。既然炸
弹，全自动机枪都在被管制范围，那么其他杀伤力大的枪也应该如此。通过仔细思考，
觉得一个合理的折中方案是用管制全自动机枪的方法管制载弹量大的弹夹。全自动枪械
并没有被禁止，只是被严格管制，相关具体法律请各位参考1934年的National

保守派的发言比较基于法理。譬如这句法律原文
“engage in other concerted activities for the purpose of collective
bargaining or other mutual aid or protection.”在设立的时候根本没有集体诉讼
的事，在过去的七十七年里也没有任何先例把这条法律解释为员工一定能集体诉讼，直
到奥巴马政府时期才打破这个传统。
哥萨奇在判决书里写了，国会当然有这个权利来给予劳工集体诉讼的权利，不过当时的
这个法律没有这个意思。保守派大法官的职业操守就体现在这，俺只负责解释法律，你
要给予劳工们这新的权利，请回去立法。俺只是法律的仆人，俺不是神。
右派的法律专家同时也指出现在的制度其实有救济之道，譬如工业界的惯例是，你要集
体诉讼？可以，那就答应不罢工。
而秦思伯格的反对派观点是基于一个更新的法律说一个上面那段原话包含了集体诉讼的
意思。这就是教科书式的法官造法。
