(1) A person is guilty of bigamy when, knowing he has a husband
or wife or knowing the other person has a husband or wife, the person
purports to marry another person or cohabits with another person.

According the the New York Penal Code section 255, a person is guilty of
Bigamy when he marries another person at a time when he has a living spouse,
or the other person has a living spouse. Since your wife is not "another"
person, I think you guys are not committing that criminal offense by
obtaining a marriage license here. |
