世上有那么多东西可以选，然而在回不回国这个问题上，有样东西没法选，它就叫“两
全”。于是就这样我们小心翼翼地走在两端的中间，在地球的最远两点之
间辗转徘徊。
我和老公都是比较随遇而安得人，喜欢漂泊，害怕一成不变掐指可以推算十年后的生活
。我们一起在美国漂泊了六年多，在回国问题上，我们比较一致，在美国在中国都可以
，哪儿觉得高兴就在哪里过。近两年正好所在firm需要派人去中国办事处轮值（每年几
个月的短期工作），觉得每年能在美国工作大部分时间，在国内又能呆一段也挺好的，
就报了名。虽然以前也是每年回国，每次回去也感触颇多，要写出来，也和海归版上洋
洋洒洒的回国小记差不多。但是现在知道了探亲式得回去，和朋友吃个饭，偶尔去大城
市逛两天，还是不足以了解真正的中国生活的。
中国的发展已经使得现在很难很绝对的说中国和美国哪个好，然而有一点是肯定的，尽

里咋想的。9个大法官里面，我有信心Breyer和Ginsberg是支持同性婚姻的，而Scalia
和Thomas是肯定反对法院介入这个争论的。Roberts, Alito, Sotomayor, Kagan从来没
在同性婚姻上表过态，但通常都认为Roberts和Alito会反对，而Sotomayor和Kagan会支

其实大家讨论的种种经济问题从根本上讲是为了自己/家庭的未来。说到未来，孩子们
的未来非常重要。
大学升学是亚裔小孩的两难问题：
一方面：跟亚裔自己死磕不是大家希望看到的。从这一点上讲，大家应该能在反对大学
入学Affirmative Action上达成一致。
另一方面：亚裔是少数族裔。很多朋友是希望低调随大流，挣大钱。当出头鸟，尤其是
在MD/DC/VA跟站在道德制高点的民主党主流思维对立不是朋友们能担当的起的风险。

其实大家讨论的种种经济问题从根本上讲是为了自己/家庭的未来。说到未来，孩子们
的未来非常重要。
大学升学是亚裔小孩的两难问题：
一方面：跟亚裔自己死磕不是大家希望看到的。从这一点上讲，大家应该能在反对大学
入学Affirmative Action上达成一致。
另一方面：亚裔是少数族裔。很多朋友是希望低调随大流，挣大钱。当出头鸟，尤其是
在MD/DC/VA跟站在道德制高点的民主党主流思维对立不是朋友们能担当的起的风险。

发帖数: 883 | 37 美国最高法院SCOTUS，我称为美国政治局常委，最近才发现，比总统国会重要多了。像
版上关心的AA等问题完全是只有SCOTUS才能解决的问题，跟谁当总统谁管参院基本毛关
系都没有。SCOTUS是总统推选，国会批准，历史上有因为ideology问题被国会拒绝的很
多例子，最近的有里根硬推保守派被民主党国会拒绝，这样才有了著名的swing vote
Kennedy.
美国政治局这些年的两极分化，跟当时被提名时的国会状态有很大关系。因为SCOTUS提
名基本不能filibuster（太重要导致filibuster很难有效），所以基本上只要控制国会
就可以推自己想推的人。目前Liberal的4位法官全都是在民主党同时控制总统和参院时
当选，而保守派的4位法官有3位是这样。只有两位法官在共和党总统/民主党参院时当
选，其中就有一位重要的中间派Kennedy。
我认为对华人有利的是更多的反对AA的中间派，我们不应该支持极左，也不应该支持极
右。右派把持下的SCOTUS判决的各种如Citizen United之类的法律也不是很好，反应富

常小，而且现在不断爆出这个夏天有人会退休的消息，这个人八成是Kennedy，只要
Kennedy一退休，最高法院就会形成5:4的稳定保守派格局，到时候保守派里面最老的两
个，Alito和Clarence，也不过70左右，所以根本没有必要和猪党谈deal。至于
Ginsberg和Breyer，肯定是能撑一天算一天了 |

美国首都华盛顿，宏伟的国会大楼东侧，矗立着白色大理石筑就的联邦最高法院大楼。
楼前端坐着两座巨大的人像：The Authority of Law和The Contemplation of Justice
，象征着法律的权威与公正。楼的正面上端铭刻着一句醒目的箴言，打动人心：“
EQUAL JUSTICE UNDER LAW”.
然而，1978年，最高法院的大法官们就在这由宪法 “平等保护条款” 凝练出的箴言下
，以5:4的票数判定某些种族可以比另一些种族更平等，从而开启大学教育合法种族歧
视的新篇章。直到三十六年后的今天，广大亚裔依然承受着这一判决所带来的严重歧视
和不公。
三十六年里，在高教种族歧视的战场，上演过无数稀奇古怪的大戏，诞生过许多奇特新
