you can NOT cross charge your visa number to his/her country of birth.
cross chargeability applies when spouse is to get GC with you in your
category, and because GC holder or US born person does not (and cannot) get
GC with you, your visa number can only charge to your own birth country
quota but not spouse's. |

priority date order without any regard to the applicant’s place of birth.
Any unused EB1 numbers which fall to EB2 would be available for use by any
country. If there were 100 extra numbers, and the 100 earliest priority
dates represented applicants from a single county, they get them.

这句话就有问题，203(e)是general rule，并没有针对SO来说，把general rule套用到
SO那是属于乱套用法律。我们认为严格的PD顺序并不存在，因为ROW PD晚得多，却能插
队到前面，所以立法者的原意是PD与国别相结合的分配方案。
在中印reach 7% limit之后，严格的PD顺序被打破，ROW开始插队，既然这时候严格PD
顺序已经不存在，说明203（e)并不适用之后的情况。
我们的观点是SO分配方案法律并无明确规定，这时就应该从立法者原意(congrational

1、律师说可以降级；AILA说USCIS接受基于旧的EB2 Labor Certification的新的EB3
I140申请。
2、雇主（HR）已答应给钱；雇主不给PP费用。
3、PP可以自己出；如果PP被拒，钱会退回申请人；没有PP审批大概3-5个月。
4、EB2的I140仍然有效，如果EB2又比EB3快，可以用EB2的I140。（不知道是否需要再
提交485及另外交费）
5、（如果新排期不倒退，）由于EB3已经Current，因此可以双飞485。雇主支付485费
用。

看看这个 我是觉得至少我会这样做：
2013 9月份的PERM 然后等批准以后（这个现在就要8个月 还是要运气好的情况下）
然后赶紧先上EB2 140 然后180天内 看下的来吗 如果下不来去PP 搞定下来
然后观望EB3 看看如果时机到了 用EB2的PERM 同时申请EB3 140 和485 双飞走起
关键的问题是 这个东西没有人说不行 或者行 但是还是要试试 而且到底是不是180天
内必须下来一个140才以后 180天以后继续其他的140 没有人知道 所以最好180天内 搞

如果现在和ROW无绿卡的人结婚，还可不可以用cross chargeability然后马上C交485?
还是需要重新file 140因为之前填的是single？
如果现在和美国公民结婚，是等EB23好呢，还是去交130好呢？交了130会不会就自动
revoke了之前的PERM和140，还是两边可以同时进行，互不影响。
考古好像没有发现类似问题，所以发帖问一下各位专家，贴个链接也行，省得码字。多

chargeability
都可能导致递交I-140的时候已经或者将要PD current
这时pp就有意义了

的是，移民局也许就看一眼你的排期(或者配偶是主申请人)然后以为排期不当前就扔一
