标 题: 新车等红灯被追尾，和对方保险公司处理赔付

事发在南加州，我在十字路口等红灯，一西裔女，踩刹车不及时，撞上我车的rear
bumper，致rear bumper轻微凹陷。对方当时就逃逸了，但是我抄了她的车牌号，并当
场报了警。现在对方的保险公司mercury insurance认可了事故，但一再坚持让我去他
们指定的body shop做评估，然后又说不限制我去别的地方修理，但又坚持去任何别的
shop修理之前，必须通知他们，然后他们会在派appraiser去我选定的body shop， 同
意了才能修理。（加州法律禁止： 保险公司限定claimant自己选择修车铺）。并且修
理期间的租车费，只能按28.99+tax /day 报，他们不管租车保险和别的费用。
还有件事情： 在我第二次去他们指定的修车铺时，对方还做了个修理费评估，比第一

了，然后这个amount就base总的wages，而不是仅仅W2 wages，现在有可能要我补交Per
Diem部分的CA TAX。我的former employer file了appeal，我是作为claimant去上庭
。我的argument就是如果amount算错了，不是我的错，我愿意退还多claim的那部分
benefits加上利息。 |
