不是关于绿卡，而是关于工作签证的，第二部分是关于EB类的绿卡，不过这个法案并没
有增加EB类的绿卡名额，而只是允许提前交I-485(交500美元处理费)和签发有效期为三
年的EAD和AP. 这实际上是个很moderate的改革，可惜当时没有通过。现在把法案贴出
来, 我觉着今年有可能会有议员提相类似的法案:

所谓reserve clause，就是指球员在合同到期后，原球会仍然对球员拥有
一定的支配权。在一个理想的自由经济体系中，球员一旦合同到期，就
应该可以自由流动，不受原来球会的约束。对于其他职业来说，这个基本
上是成立的。但是在职业体育中，实际上却不是这样。在许多职业体育中，
原球会如果有意愿，都可以有一定的手段可以留住这名球员。这种权利就
叫做reserve clause。一个比较容易理解的例子就是足球的转会费。在
Bosman条款生效之前，即使球员和原球会合同已经到期，球员如果想离开
去和其他球会签约，原球会都有权向新球会索要一笔转会费。也就是说，
球员的流动并不是自由的，而是受到原球会制约的。
MLB的reserve clause由来已久，历史上多次球员和球会之间的法律纠纷都
是围绕这个条款而来的。这个以后我有机会再慢慢详细说明，总之，经过
多年的斗争，现在MLB的reserve clause已经被大大削弱，但仍然是球员
交易中一个重要的组成部分。

你看看第一修正案establishment clause下判的都是什么案子？不是政府直接参与宗教
或类宗教活动（公立学校祈祷，钱币上印in god we trust，政府出资在公共土地放耶
稣诞生creche），就是政府在用钱上流向宗教组织（比如公共款项资助私立教会学校）
。对信仰者个人的歧视从来不是在establishment clause下处理的。而是在due
process clause（联邦政府）或equal protection clause（州政府）下处理的，宗教
信仰是和种族，国家来源同一等级的suspect class，也就是对信某教者的歧视和种族
歧视，国别歧视是相同的处理方式。同时我这个贴子里一再说了，在外国人移民入境方
面没有通常的due process保护，这是100年来的判例确立下来的。换句话说，对外国人
入境移民，在宪法层面上，可以进行种族歧视，国别歧视（这两点已有判例确认），类

的。
回到这个case，paspa本身没有问题，commerce clause，也不存在强迫nj执行的问题，

1，美国为什么一直都用一部宪法？美国之所以能这么做是因为美国是common law也就是
案例法。除了正儿八经的修正案以外(现在提修正案已经很困难了)美国最高法院的没一
个跟宪法相关的判例都是对宪法的修改，美国宪法原文很宽泛很宽泛。比如美国宪法里
面有一条叫做Necessary and Proper Clause，就是说国会可以制定任何法律来实行宪法
里面提到过的条文只要这些法律necessary and proper，这个你就充分的发挥你的想象
空间吧。然后比如Commerce Clause，本意是说国会有权管理州与州之间的商业，但后来
历史上由于最高法院法官组成不同，对这个很模糊的概念的解释变了4次，后来变成连你
在家里种小麦都可以管，因为这个可能影响到interstate commerce。总之，美国宪法之
所以能用200年，只是因为它原文很宽泛，然后因为是案例法，所以实际上美国宪法是每
