如果大家喜欢看传奇故事，最近的几个case都是罚罪从无，而且原因是警方刑讯逼供。
所以，孙维confess了也是被刑讯的。但是现在还没到出牌阶段。
孙一个人智商不可能这么高，这后面是个聪明的富有经验的集体处理这个case。
北京警方是不够级别的。再踩没用了。

对非法庭的其它人的confession（有privilege不算，比如夫妻之间，客户和律师之间
）在审判过程中同样可以作为证据。在被警察限制行动自由状态下对警察作出的
confession必须要在警察给予了Miranda warning（你有权利保持沉默和请律师在场）
后才能作为证据。这也是为什么美国警察逮捕后立即会给予Miranda warning的原因，
因为只有这样之后被逮捕者对他们说的话才能成为证据。美国证据规则中的hearsay
规则有一个例外叫statement against (penal) interest。你可以去查是什么意思。
你说的这么斩钉截铁，有什么根据？你对美国法律有多了解？ |

为美国遵守疑罪从无原则，即公诉人不能提出确实充分的证据证实被告人的罪行，法庭
经过庭审和补充也不能查明被告人 有罪的事实，那么就只能判定被告人无罪。目前FBI
手头没有足够多的证据控告Christensen有谋杀莹颖的嫌疑，尽管联邦执法人员对嫌疑
人进行了窃 听，但就目前公开的证据来看，只能起诉犯罪嫌疑人“绑架罪”。
考据起来，这好像是从检方传出来，并且得到章YY家华人律师赞同的。这很值得华人社
区警惕。
事 实上， no body, no murder，这早已经是久远的法律历史。随着科技发展，凶嫌们
毁尸灭迹或者完全掩盖的本领越来越高，西方世界从上个世纪50年代起就开抛弃了这个

把俺这老留都惊呆了。。。
实验室里一个来帮忙的小留，国内来的，因为是老乡，所以关系不错，他的女友和室友
还有他的一些朋友都是国内来的，通过他也认识一些，这些小孩儿家境都不错，否则也
不会来我们这个南方的私立大学。
Thanksgiving 的时候这个小留和他的女友还有那个室友一起去参加 party，酒后驾车，
在居民区车撞在了转交的一棵树上，幸好那时候车速不快，没出什么大问题，并且也没
有被警察碰到，他们打电话给我，让我去接他们。
我去的时候，三个人已经在他们的车里醉醺醺的睡着了，砸窗户叫他们起来，三个人还
是晕乎乎的；
上我的车，三个人挤在后座，这会儿大概有些精神 |

首先，孩子还是会回来的，但是估计你的上庭。你还有参加学习班，那个学习班非常可
笑，但法官肯定会让你去。还有法官会让你做精神鉴定。律师在这种官司中的意义不大
，因为法官只相信医生的证词。而没有医生会站在你这边， 因为所有的医生都被教育
说眼底出血和颅内出血就是虐待。
其次，这种事和种族歧视没关系。白人和黑人这种事比咱们多。寄养家庭的妈妈黑人妇
女居多， 没有几个亚洲孩子。
没有几个医生真正明白是怎么回事， 大部分都在背书，就像回帖的一位医生， 低处摔
伤不可能造成眼底出血这个结论是如何来的估计她也不知道。 这个结论不是通过严密
的科学实验来的， 而是来自于回顾性的统计研究。回顾性研究本身漏洞比较多，更何
况对照结果来自于调查父母的confession. 而confession是很靠不住的。所以眼底出血
和虐待的关系是没有明确的科学根据的。
不要责难这对父母。 有些孩子轻轻一碰就会出现眼底出血， 如果你的孩子没有只能说
你幸运， 没准哪天就抡到你。 你的孩子头大很可能有先天性脑积水， 很多孩子都有

还小，不必太紧张。
Lies come out of children's mouths for a variety of reasons:
Fear. When kids are scared of the consequences of their actions, they
often lie to cover up. (Are the rules too strict? Are the limits too tight?
Does your child feel free to talk with you?)
To protect somebody else.
Because she is imaginative and the truth is boring.
