5 editor letters, 5 independent letters
20 review from 9 journals

However, my citation is low (Engineering), which is the weak point.

最后一步MTR是自己做的，采取针对IO问题组织材料。
最后在io的来信中提到认可我的贡献以及我的文章重要性。
另外在DENY以后拿到O1签证换了工作。
最后MTR 通过。

Basic background, I submitted my RFE without adding my case number (My
mistake. I originally planned to photocopy the RFE letter since both SRC and
A numbers are on the first page, but right before submitting the RFE, it
was found that only the yellow page was required. I did not notice that
there was no SRC or A# on that page, stupid!!)

issue
two EADs at the same time.
I am not sure that this is the real reason, but typically we advise people
not to complicate to submit 485 EAD and OPT ead apps together. Because under
normal situation, they should deny your F1 OPT EAD and approve your 485 EAD.

were paroled into the U.S. on 07/10/2009 you were no longer in H1B status.
On 09/15/2010, you were again issued H1B status. Therefore, it appears that

case，是请律师帮忙准备的材料。
第一次提交EB1A材料时的基本背景如下：claim 老3样
第三国生物Phd；（目前是J1 visa holder， waiver已于这个月批准）
文章10篇（first author 4篇， co-first author 2 篇， 其中JBC 2篇，另4篇出自2
个journal， IF 分别是9分和10分。 另4篇非first author文章中有science，Elife等
）（另：其中一篇文章，发表的那个10分的杂志专门请人就那篇文章写过commentary）
；
Total Citation > 400 （不包含自引）， 其中一篇文章citation>170， 另一篇>100 ；
共6封推荐信，2封是分别出自Phd和Posdoc老板，另4篇independent recommendation
letters分别来自美国，日本，英国和中国。
共审稿18篇，大概6个journal， IF 大约3-4；

发帖数: 678 | 31 在TSC的case，今天网上查状态denied了。一个半月前提交的RFE回复，背景有些瑕疵。
paper 4篇，书的章节一个，总引用~170，不过集中在一篇我三作的文章上有130多。评
审很多, >50。RFE当时是不承认contribution和totality。现在还没看到decision
letter。
RFE response的时候，发现google citations把我一个~20个citations的一作论文算成
7个引用，而且至今不改。为了平衡引用的分布，我还是自己去算了一下这个一作的引
用，然后混编了引用小结。不知道是不是vo也查了一下google citation。
回复RFE的时候要了好几个大牛的reference letters，感觉都写得挺给力的。最后还是
没发挥作用，想想还挺郁闷的。
Denied之后一般情况就move on了是么？我想这种border line case也不太可能去上诉
。我等一等最近新论文的情况，然后问问公司Eb1b好了。 |

州立大学AP，学校给file了EB1B，还用了pp加急，现在收到了Notice Of Intent to
Deny。老婆怀孕，娃马上要生了，紧急求助！
请问这个notice of intent to deny是通常所说的RFE吗？
USCIS在criteria analysis承认了我meet了6条中的2条：review和publication，但是
在final merit analysis里面质疑了以下两点：
1. 我有70个journal和conference reviews。但是USCIS觉得这些也许都是peer review
，没有证据证明我是“small, elite group of referees”。所以不能证明我的
international recognition
2. 我有6篇journal publication，其中4篇一作，另外19篇conference publication。
但我的总引用数是52个，USCIS觉得引用数太少所以不能证明我是outstanding in the
field

我并不知道律师是怎么写的，只是在intent to deny notice里面才知道律师claim了四
项。
下周和律师开会，是不是要叫律师把deny的第一条去掉 （1) Published material in
professional publications written by others about the alien's work in the
academic field. Such material shall include the title, date, and author of
the material, and any necessary translation）？请问还有没有别的建议？ |

求问：这是正常的withdraw 状态变化吗? 我的理解是 状态应该变成 case withdrawl.
还有我之前是pp的case,不是在他们收到withdrawl的信后，半个月后状态 就变成case
withdrawl吗？ 到现在都3个多月了，才出最终状态。我怎么感觉我这个case的变化不
太对。留下deny的历史后，怕对以后重现申请又影响。
求有经验的 dmjx 说说看。

发帖数: 367 | 43 这大半是律师或公司的差错. PERM ETA9089表有两个地方提及到WAGE. 一个是
PREVAILING WAGE, 还一个是CURRENT WAGE. 后者必须大于或者等于前一个.
RECRUITMENT有一个地方必须提及WAGE: 十个工作日的公司内部通知(NOTICE OF FILING
). 这个WAGE 必须是前面提到的高的那一个,或者是个RANGE, 但是不能低于高的那个工
资. 另外一个地方是三十天的STATE WORKFORCE AGENCY POSTING, 有个别的州要求必须
DISCLOSE WAGE, 有个州不用.
如果RECRUITMENT用的是PWD, 但是CURRENT WAGE在ETA9089上又大于PWD, AUDIT以后,
DOL会认为雇主故意用少的工资打广告, 让US WORKER对这个工作不感兴趣. 这个大家都
好理解.
我比较感兴趣的是这个CURRENT WAGE比PWD高多少才会被DENY? 万一真是雇主不小心填
错表了, 差个一两百块的DOL怎么处理? 尤其是现在PERM用那么久才会被批, 被AUDIT后
更久, 等PERM DENY |

公司去年按EB3递了laber of certification俺的申请材料，
两个月后被通知audit并要求补材料，材料递上去6个月后的
今天收到了被denied的通知，都是鸡蛋里面挑骨头的理由。
我进公司之前拿到了硕士学位，如果现在重新递申请，能走
EB2 吗？DOL 会不会把我目前被deny的case翻出来一起审核？
现在重新file的话究竟是走EB3 稳妥还是该走EB2？
大家有没有什么高见或听说过类似的case？
