在removal proceedings可以上诉I-485被拒的原因。如果移民法官同意你的I-485被拒
是USCIS错误，他回给你批。
另外，在removal proceedings可以跟移民法官file I-485。所以如果你一开始的I-485
的确是你的错误被拒，但是被拒后如果你仍然有重新file I-485的资格的话，你可以再
次递交I-485。只是如果你在removal proceedings，I-485必须跟移民法官递交，而不
是跟uscis递交。
最后，如果你被拒后没办法file I-485，也不等于一定有10年的ban。你在removal
proceedings可以向移民法官要求voluntary departure。如果他给的话，而且你按照
voluntary departure的条件离开的话，就不算被removed，就没有这个ban。 |

弃绿卡的李先生，近日因公入境美国，看到友人赶著在报税截止日前申报所得税，窃喜
不必再担心是否要申报海外帐户，也不必在美申报所得税。然而会计师提醒，随税法不
断改变，目前放弃绿卡者若未完成「埋单」手续，仍有义务申报所得税。
会计师胡桦臻指出，早年只有放弃公民的人要缴弃籍税（expatriation tax），放弃绿
卡者无此要求。随税法不断修改，变成只要持绿卡超过八年，且所得与资产符合税法要
求，即须与放弃公民者一样缴弃籍税。
但一项修法使2004年6月3日至2008年6月17日间，放弃绿卡或公民者，无论是否意图逃
税，只要过去五年每年平均缴所得税超过14万5000元，或财产市价净值超过200万元，
须马上「埋单」，向美国缴交所得税。
而后须将国务院核发的放弃绿卡或美籍表格附在寄给国税局的8854表，才算完成税法弃
籍要求。否则一样有义务就全球收入在美国申报所得税。
2008年6月18日生效的最新法规规定，不论放弃绿卡或公民出自有意或无意，在弃籍前

, there is no problem at all.
the airline will report your departure to homeland security within a day or
two.

I-102 表是干什么的？是补发你 I-94 卡用的，或者说是给 USCIS 送钱用的。为什么这么说？你去补补老师的 I-94 课就全明白了。一句话，如果不是在境内调整身份没办法，需要原件，I-94 丢了就丢了呗。至于残缺、有误，那就更没关系了。当然，送不送钱还是你自己决定。
提醒同学们注意的一点时，此表不要乱用。
老师在这里讲一个真实的故事。有位同学毕业了申请 H-1，批了，但 I-797 上的个人信息有错。电话打到 USCIS，被告知填这个表。照着做了，谁知道，收到的 I-94, 是他 F-1 的。他认为移民局搞错了，应该给他寄改正了 H-1 的 I-94。
移民局是出错了，但不是处理 I-102 的人错了，错的是告诉他提交 I-102 表的那个人。错在根上了，根本就不应该填这个表。I-102 是给你一个现在的 I-94 卡，你现在还是 F-1，H-1 要到十月份才生效呢，不是吗？... 阅读全帖 |

发帖数: 32 | 24 关于H1B持有人是否使用AP、EAD的问题已经被问了无数次， 版主可不可以置顶一段时间。现在很多人都有EAD、AP但485还要1－2年才批，一个清晰的FAQ相信对大家都有益。
以下是我目前所了解的情况，有些地方我还有疑问，请大家补充，更正，我会及时更新：
以下先集中几个关键问题，一些常识以后补充：
（1）用了EAD，就是AOS，就不是H1B，不是non-immigrant了,这个大家都知道。
万一485出问题，你必须马上离开美国，这个虽然很麻烦但不可怕。
关键是Out of Status 的开始计算时间，因为这关系到3年/10年不得入境的条例。根据下面皮匠的blog以及他引用的USCIS的说明，OOS的开始时间是485被据那一天，而不是EAD使用的那一天。这样使用EAD就不用担心这个问题了。

今天豁出老命去了边境的CBP（回国的行李箱都装满带上了），officer并没有刁难太多
就给issue了一个新的I-94，根本没有出境。买了蛋糕欢快的和身边所有人庆祝了一天
（$$$）。回来仔细一想，又是一身冷汗：
1）新的I-94和网站上查到的出入境记录如下：
Departure date:
4/18/2017 00:00
Arrival date:
4/18/2017 13:45
Admit Until Date :
4/20/2017
这样的话那么从上次给错的I-94到期日2/15/2017到这次所谓的"departure date"4/
18/2017之间不是有了一个大gap了吗？
2）更离谱的事：律师竟然在昨天（4/17）就把H1B extension file上去了，那按照我
现在这个I-94来看的话我只有在4/18到4/20间才算合法居留，那么昨天寄出的材料会不
会不生效？移民局认定H1B extension上交的合法时间是按照收到的日期呢还是我们寄

Newark Penn station is not very safe at night, but no need to go there.
Just take the train straight to NYC Penn station which is reasonably safe.
If there are no more Amtraks, you can book a bus... Megabus has a
departure at 1:30am from near Penn station, Greyhound has a departure at
midnight from PABT (NYC subway is 24 hours if you need to go to PABT).
Book in advance to be safe. |

内吧，晚上周围也有别的车在那儿停下接人。没有officer过来开罚单，但是不知道会
不会有camera之类的拍下来，事后给我寄过来罚单？
今天进去时候一不小心走错道了，本来应该去departure，结果走到了arrival，第一次
走错以后我继续往出走，想着转一圈应该还可以走到departure，结果再次走错。走错
一次再想走对还是有点难度啊。之后心想干脆就直接放下他得了
有没有有经验的板油啊？多谢啦 |

Green Parking) 就行了,然后你走着过去,terminal 1 做电梯上到departure,顶多用十
分钟.看一下地图就行了.
