我对里面一段"F. VISA AVAILABILITY DURING THE COMING MONTHS"的理解是证明了
USCIS确实在刻意等DOL的backlog.但是由于DOL进展比想象缓慢,眼看着名额要浪费了,
于是这个月放了EB3 Rest of the world一马.
里面有一句"Such movement could be expanded to include other chargeability
areas and preference categories"比较鼓舞.可能下几个月其他出生地的也会稍微动
一点.
不知其他人有什么理解.
当然只望着这些没用,还是催者促进移民改革要紧.最近的几个新法案(STRIVE, SKILL,

催律师问了DOL,回复如下：

月份的时候将Perm Application递交上去。当时出了一点意外，DOL发给我老板的
verification email被我老板可能是误删了，无法从邮件的链接进行确认，我和律师都
在那干着急，也在想办法能不能通过其他办法向DOL确认。
在9月份的时候，我收到公司B的offer，也决定去公司B。Perm的事情也有点不了了之。
10月份马上办理H1B的transfer，并在12月底被批准。这个时候，原来公司的律师告知
在公司A的Perm application也被批准了。
我想在这个情况下我有哪些选择呢？是否可以与公司A商量继续帮我办下去（140， 485
）？还是要Cancel这个Perm，重新在公司B办？
不知道有没有人和我是同样经历。 |

1. 今天八月提交了PERM，请问如果以后140通过的话，那么PD应该是DOL收到PERM的日
期吧？还是收到140的日期？
2. 如果在PERM通过之前title升了一级，从码农II变成III，还会在一个组，做的东西
也基本一样，那么之前提交的PERM还有效么？还是要重新提交PERM？
3. 如果PERM通过了，开始140的处理阶段，如果在140通过之前title高了一级，工作还
是做之前的活，那么需要重新走一遍PERM么？如果PERM要重新提交，还有如果PD是从
DOL收到PERM的日期开始算的话，那我之前PERM拿到的PD还能保留么？

网上提交9089时候当然不需要提交什么voe, audit时候不清楚. 但perm批准了,提交
140时候肯定需要提交voe. 并且voe里面要证明你的perm广告里面的skill
phd ra不要算. master+0好了. 最多audit recruiting,但dol不会置疑你的经验. 比
如如果算了master+3yr,最后dol不认可你这个3yr经验. 你广告都白打了,还得彻底从头
来.
master+0yr, ms(phd preferred)+0还是等同于ms+0year, 而且容易招audit.
如果没打广告,至少要等2个多月吧. |

not received the case #, only an email saying that my case has been filed. I
also asked back in Feb if they have received the email from DOL, they just

DOL thought Fragomen was involved in the candidate review process. Though
the audit has been stopped, all audited cases returned to normal process,
Fragomen's name has been cleared, DOL still issued a guidance in attorney's
involvement in the candidate review process.
Unless the immigration attorney is normally involved in the company's hiring
process, the attorney should not be involved in the candidate review
process. |

发帖数: 367 | 40 这大半是律师或公司的差错. PERM ETA9089表有两个地方提及到WAGE. 一个是
PREVAILING WAGE, 还一个是CURRENT WAGE. 后者必须大于或者等于前一个.
RECRUITMENT有一个地方必须提及WAGE: 十个工作日的公司内部通知(NOTICE OF FILING
). 这个WAGE 必须是前面提到的高的那一个,或者是个RANGE, 但是不能低于高的那个工
资. 另外一个地方是三十天的STATE WORKFORCE AGENCY POSTING, 有个别的州要求必须
DISCLOSE WAGE, 有个州不用.
如果RECRUITMENT用的是PWD, 但是CURRENT WAGE在ETA9089上又大于PWD, AUDIT以后,
DOL会认为雇主故意用少的工资打广告, 让US WORKER对这个工作不感兴趣. 这个大家都
好理解.
我比较感兴趣的是这个CURRENT WAGE比PWD高多少才会被DENY? 万一真是雇主不小心填
错表了, 差个一两百块的DOL怎么处理? 尤其是现在PERM用那么久才会被批, 被AUDIT后
更久, 等PERM DENY |

If yes, all you can do is to wait. DOL just started to process 9/07 audit
cases.
If not, you definetely need to write a letter to DOL or senator, do what
ever you can, since they should process as FIFO based on PD, and your case
is much earlier than current processed cases.
But since you got promotion, the PERM you filed in 9/07 may not fit on your
new position any more (based on the title). You may have to start a new PERM
with your new title on it. In this case, you will los |

case by Fragomen will be audited. Later on, DOL withdraw the decision. But
then every case will still go through a normal audit process. So
unfortunately, mine was picked up for audit again the second time. Then it
is no information since then.

发帖数: 367 | 43 同学们, DOL 发话了. 08年6月及之后SUBMIT的PERM都暂不处理, 等DOL决定. 有可能会
拒掉一些, 有可能会开始SUPERVISED RECRUITMENT, 也就是说可能又会回到象以前
TRADITIONAL LABOR CERT那样, 成立一个BACKLOG CENTER.
还有就是从今年七月份开始PERM要用新的FORM了. TNND. 现在的FORM已经够长了, 据说
要将近20页. 还不知道长什么样呢.

5年本科之后；2年硕士之后）。所以按DOL算，只有5.5年工作经验（因为只算本科之后
，而且不算现在的工作） - Bachelor+8years 我不满足
- 我现在的职位也接受Master Degree + 五年工作经验。但是在DOL看来，这五年应
该是MASTER之后的。这样我也不满足条件
- 公司坚持不会为我的绿卡改变公司的job requirement for my position
- 如果因降职被audit，老板说可以提供充分经济理由，其实公司其他职位已开始
cutting hours
- 目前状况-已经打了广告，但只在我公司网站上打了广告，因为requirement写的
不好，就发现有一个无法disqalify的candidate。准备6个月后再重新打,虽然我的时间
非常紧，但律师坚持
- 如果降职（同一类，但是从senior一些的二级降到低一些的一级）是唯一出路，
是不是就不用等6个月了？？？应该着手重新做？

baccalaureate progressive. That way you qualify for the position, and it
satisfies EB2 requirements.

every case from Fragomen. But later on, DOL announce again to release the
special audit from Fragoment. But still those cases will go through normal
audit process, which is 60-70% probability of being audit. Mine was audited
second time. Do not have any information so far. I guess you are being
audited second time just like me. |

我问律师，律师说DOL的官方网站才承认处理到去年8月的，所以没有什么办法，只能等。
