成是个美国人（我们的building基本上都是中国人），他们觉得landlord觉得不敢这么
做。也去问过学校的律师，他觉得这是显然不公正的。
在当庭询问的时候，法官也指出lease上只是写着我需要为我的过失造成的堵塞负责，
但是对方都没有证据证明是我的过失，他们甚至没有清理公司的收据 （对方的经理当
庭承认了）。进一步说，就算lease上有，这也明显不合理：任何人都不应该为别人的
过失负责。
现在觉得对方律师援引的法律可能是影响法官的关键，但是什么构成duress也是分不同
情况的。一个threat对于普通的美国可能根本没有什么用，但是对于个初来乍到的外国
人就完全不一样。我当时也没有分辩，觉得法官会自己判断。结果大错特错。
我觉得美国这种司法系统最大的问题就在于，你根本不知道什么证据法官会采纳，他会
采纳多少；什么证据对他来说有说服力。对于一个新手来说，你根本不知道法官在想什
么，然后他就宣判了，不给你任何分辩的余地。如果是一个律师的话，他当然会比较了
解法官会想什么（而且这个律师似乎和法官还很熟的样子） |

，就是把所有的分数全部都改到及格之后签了review,没有PIP。当时，我就谈了3点。第
一点就是这个PIP的内容，我要跟我的律师核实商量一下之后再签；第二点就是，我当
初是公司到我们学校系里通过校园招聘的方式招过来的，如果给了我这个PIP，可能会
影响公司的名声，很可能以后公司在学校里再也招不到人了；第三点就是，我可以接受
被lay off,但是不能接受被fired。
当时经理听了之后，沉默了一会就把材料都拿走了，可能跟公司高层商量去了，可见经
理也是承受了压力。最后裁员的时候没有裁到我，但是经理在一年多之后就被公司逼走
了。所以，我觉得他也是没有办法的。
现在看来，如果以后还有类似的情况发生，我肯定不能这么做了。曾经看到一个帖子就
是说，在这种情况下是必须要签的，不签的话他们可以当场fire掉。而且，既然公司已
经做了这个决定，给你看一下就是说明你已经知道了，你签不签都要被PIP。
曾经有人也建议可以签，就是在旁边注明under duress，然后要求公司签名之后拿一份

1. Racking slide using the full palm. This is recommended for both emergency
reload and malfunction clearing. Don't use thumb grab because thumb grab is
