sense,在美国的话，刑事诉讼是由District attorney提出的，目的在于punish。死者家
属可以提出民事诉讼，目的在于补偿。
早期的common law, death of party terminated lawsuit，this created lots of
injustice & anomalies, for example, it's better to kill someone than to injure
him. 目前可以有两种cause of action: survival and wrongful
death，共同目的是让suit continue.
在美国，如果卡车司机恶性作案的话(egregious/flagrant disregard)，死者家属可以索
要punitive
damage，一般会是赔偿多不少。但是如果只是一般的negligence,得到punitive damage
award的可能性非常小。
现在国内律师也不少，这个案子不见得会赢很多，但是应该是非赢不可的， |
