我最近遇到一件关于行医执照的比较特殊的事情，就发生在我身边，想向版内高手请教
一下，看看能否对我自己有借鉴。
一个欧洲人，从06年开始在美国做Clinical Research Fellow，现在Texas。他的住院
医生和专科培训都是在意大利做的，从来没有参加过USMLE考试或者任何美国的临床
Fellowship Program。现在的老板是业内牛人大佬，力挺他，把他当做心腹，从08年起
就开始让他跟着上台做手术，至于他是否有、或者有什么类型的Texas执照，我们都不
知道；而且我观察到我们科室的其他医生也不让他跟着上台，当有Joint Committee到
医院检查的时候也让他回避。
因为这多年做Research Fellow，文章倒是不少，加上老板处处力捧，才30几岁CV已经
很漂亮了，在圈子里面也有些人脉。前几天听说，老板推荐他到纽约州纽约市的一个医

章很麻烦，耽误了2个多月，材料才得以从学校寄出。个人觉得申请算是比较顺利。把
我当时准备的情况跟大家说一下也许对将要申请的人有一点帮助。
我个人从这里寄出去的材料包括：
1.国内护士执照的公正，在这里网上找的公证处，在纽约，叫最佳公正，电话
7183212810
2.指纹卡，就在我住的地方的警察局办的，free
3.handbook上的申请表，贴一张照片在右下角（handbook链接：http://www.rn.ca.gov/pdfs/applicants/exam-app.pdf）
这一页有一项是填社会安全号，我当时没有就空着的，没有关系。
4.两张支票，一张办指纹的($51)，一张申请的($75)
5.写了一封信，表示感谢，一张纸，很客气的几句话
从学校寄出的材料：
1.中英文成绩单（学校有，我来之前到学校教务处办好的）
2.学位证书和毕业证书中英文版（来之前自己办好到学校教务处办好的，盖好了章）
3.课程描述9门（内外妇儿、精神科护理、生理、解剖、免疫、微生物，好像是这些，

留学生是415一个学分，绿卡减半，下学期好像又要涨一点，
suny是州立系统，cuny是市立系统，
我一个同学BMCC毕业的在我们program，
他BMCC用的paper都可以拿过来接着交，
每次只要挖挖以前的paper拿来交就行了，
说明ASN和BSN很多课其实都差不多的，
就是听说suny downstate学校那边很多黑人，
你实地跑一次去看看，但是他们有自己的medical center，
我选hunter因为地铁方便，在曼哈顿，大部分都是白人和亚裔，部分黑人，
SUNY他们那个program prefer有绿卡的学生，要申请要尽量早点。
RN－BSN Nursing的课都是每学期几个paper APA format，
老师都会提前告诉你要写什么，
最多就是有个期中考，有些没有期中考，
期末一般没有考试，平时就是听老师讲课，
看看老师给的文章，做几个online的certificate考试，
最多一个paper，然后期末就是group presentation。

The answer I have now is the Examiner cannot, but I am not 100% sure.
Essentially, what I am asking is:
Can the Examiner use a non-prior art article as the secondary reference to
fill the gap between X and X+Y.
1. ODP is still talking about Obviousness. The examiner still needs to
establish a prima facie case of obviousness with prior art which does not
include the inventor's own academia article within one year.

假设你的application仅有一个claim，是这么写的：A device comprising A，B，C，
and D。
攻略分支一：examiner发现一个prior art。重点是：A'BC在prior art的
specification里面出现了，但是prior art的claim里面并没有A'BC, 只有D。（<--看
我看我！这句是重点！！）这个时候，examiner是102rejection的。这个时候他看不看
有没有common ownership其实没有关系。因为有没有common ownership，他发的都是
102rejection。而applicant拿到102 rejection以后，有common ownership的，就提交
132 declaration证明给examiner说我们有common ownership。

留学生是415一个学分，绿卡减半，下学期好像又要涨一点，
suny是州立系统，cuny是市立系统，
我一个同学BMCC毕业的在我们program，
他BMCC用的paper都可以拿过来接着交，
每次只要挖挖以前的paper拿来交就行了，
说明ASN和BSN很多课其实都差不多的，
就是听说suny downstate学校那边很多黑人，
你实地跑一次去看看，但是他们有自己的medical center，
我选hunter因为地铁方便，在曼哈顿，大部分都是白人和亚裔，部分黑人，
SUNY他们那个program prefer有绿卡的学生，要申请要尽量早点。
RN－BSN Nursing的课都是每学期几个paper APA format，
老师都会提前告诉你要写什么，
最多就是有个期中考，有些没有期中考，
期末一般没有考试，平时就是听老师讲课，
看看老师给的文章，做几个online的certificate考试，

「菲律宾对中国」南海仲裁案，常设仲裁法院今天公布结果，称中国大陆在9段线范围内主张的历史权利没有法律依据，而南沙群岛的所有海上地物，均为礁岩，包括太平岛在内。

在美国洛杉矶华人聚集区之一的蒙特利公园市，一项眼科健康调查（CHES：CHINESE
AMERICAN EYE STUDY）正在华人社区中展开。
奇怪的眼科检查
在美国定居多年的华人王丁（化名）参与了这项调查，现在他开始为这个调查感到百思
不得其解：“说检查眼睛为何要获取我的血样和DNA？”。
这一切要从9月说起，王丁当时接到CHES工作人员的电话，征询他是否愿意参加这项眼
科健康调查计划。60多岁的王丁眼睛不太好，当他看到这样的免费服务，而且又是当地
一家有名的眼科医院检测，他满口答应下来。
在当地，眼科检查至少要收取65美元的挂号费，如果再加一些眼科治疗，费用可能在几
百美元甚至上千美元，王丁说：“CHES不仅不收费，而且还承诺25美元的车马费。”对
