IRS那个officer，坚持说不能，只能是non-resident，不能联合报。
他是严重违法的。
我是合法的，
1. IRC 说是2个calender year
2. publication 519 for 2010 说是2个calender year
3. 中美之间的treaty 说，not exceeding 3 years
那个officer坚持，第三条。并且说，treaty preference to IRC.
已经多个回合了，他就是不改，我要求appeal 和开庭也没结果，就是拖着。
这是2010年的报税。
他错在：
1. not exceeding 3 years， 并非必须3 year， 1 year， 2 year 也可以。他故意曲
解法律。
2. IRC 在税法中是上位法，IRC preference treaty。 他难道连基本的法律常识都没
有吗？
我怀疑此人故意刁难中国人，可能是种族主义者，准备告他，特此寻求支持！ |

In my group, only 25% people get exceed expectation, which means they will
be promoted.
My first year review (actually only 3 months, I think I self evaluate two
items as emerging, which I guess is less than 2. And the manager gave me
emerging also. My overall is meet expectation. It seems they are satisfied
with me.
This year I got at least one emerging item, but got exceed expectation
overall.

简单说下背景,上班快3年了,去年开始做了很大的一个项目,我是SME, 基本上组里所有
process, tool都是我开发和主导完成的,现在技术上是组里顶梁柱. 去年一年加班无数
,成就也不少,上过公司(大公司)月最佳员工表彰,被评为项目MVP,年终各方面考核都是
超标,老板给的评价也是exceed expectation(大部分同事都是meet),还说推荐升职.
本来想今年评级加薪好好跟老板谈下的, 可年初很倒霉又碰上了re-orga, 老板和大老
板都换了...评级和加薪和新老板谈! 当时就觉得不妙,不过想想去年的成绩都各种事实
摆那了,跟新老板好好交流下也应该还是有点资本的. 于是准备了一堆资料去和新老板
谈,哪只一上来就个晴天霹雳,压根不谈去年的事,就说你前老板说你是exceed,今年给你
涨工资3%(比我去年的还低), 说今年组里很多人都没涨,你这个已经高于组里average了
,然后压根不提升职的事,开始忽悠今年有啥啥好项目,怎么怎么好好干,明年给你升职..

发帖数: 2012 | 9 如果B是Exceed Expectation其实也可以了。因为A是Significantly Exceed意思就是必
须升职，这个就不是完全以你表现为准了，因为老板还要平衡部门其他员工的情况。B
也不是说不能升职，但升不升的主动权就到了老板手里了。所以要不是你优异得眩目老
板也铁定升你，一般不会给A。另一个情况是你的职位比较高，升职不是掌握在老板手
里，老板就更不会给你A去强迫老板的老板给你升职的。
在不一定升职的情况下，可以尽量要求老板多加薪，有时候其实加薪可以远远超过升职
的情况，这样你如果年资较短其实对你是有利的。既加了薪别人又不知道，不容易引起
其他资深员工的羡慕嫉妒恨。
如果这些都做了也既不加薪也不升职，你就需要考虑去外面找offer了。 |

较。前两天还在要求给她rating高点，bonus 多点，自评exceed。还有一点，可能更年
期吧，平时布置工作时，一不高兴就爆发大吵。。。
以前我是能照顾就照顾，给她比较好的compensation。今年年终review 结束前，我
manager跟我说她今年只能是achieved，估计是exceed的名额有限。
我担心跟她1：1 meeting 公布rating时，她会爆发。
当然我也不想影响她明年的工作积极性。大家觉得我怎么跟她解释为好？把理由推给
manager定的似乎也不行，

况且那5000也是EB4里面的一个限额，跟EB3毫无关系。
EB3里面的EW确实有个全世界的限额，是每年10000，但EB3C年度限额2503是包括EW的，
所以你不能排除EW来单独计算余下的EB3C。
另外你说“中国的 EW 绝大多数都是 CP。”也是错误的。根据最新FY11公布数据：

中国EB3C CP总共实批1492，其中EW只有404，而普通EB3C有1088，仍旧是占绝大多数。
并且我计算的EB3C CP比例是根据实批数据计算，所以所谓CP 拒绝率远高于 I-485之类

综上，我计算的EB3C CP:485总比例1.42正确无误。EB3C里面的EW CP:485会高于1.42，
其余EB3C的CP：485比例略小于1.42，但EW总体比例很小，不影响大局。

按：本文是上个月写给 NIU 会员的。如果懒得看全文，可以提前告诉你结论是：EB2
占用 EB3 名额虽然字面上是不违背移民法条文的，但是目前实行的联邦规定不允许这
样做。如果有 EB2 的人愿意争取 EB3 的“剩余”名额的话（如果有），可以尝试从这
里面做文章。
根据移民法规定，在一个国家 EB/FB 总额不足 7% 时，所有类别的排期都和 ROW 一样
，也就是说可以在任意类别中占用任意多名额，只要总量不超过 7%。而一旦总量超过
7%，即变成 "oversubscribed" 国家，在排期中，是该国家至少有一个类别排期早于该
类别 ROW。但是，要求 oversubscribed 国家所有类别都受到 7% 限制，这就显得不够
合理了。
从本期 Visa Bulletin 来看，EB2 成为中国大陆唯一一个排期早于 ROW 的类别。

potential use of the money, or allow people to withdraw their exceeding if
they don't like to the proposed plan. And we can be transparent about the
plan in the fundraising post in advance. This may help avoid some potential

一警察，马上掉头把我揽下，说我超速，超了14mile。我还从来没吃过超速的tichket
，驾照没有任何不良记录，连parking都没有。警察问我有没有吃过ticket，我说从来

不过最重要的是， 就算你愿意缴税， 这几点CTU做不到：
1. 多交的税是给养工会和Admin还是到学校了？
2. 到学校的钱是浪费在admin上还是加工资了？
3. 加了工资是否老师水平提高了， 教育制度提高了？
这些答案都是否定的。
还是同样的冥猪党的无底洞。 你倒多少钱没有用， 制度问题。 老毛的大锅饭搞死多
少人， 这就是一样的老毛的梦想。
最重要的， 今天加了16%， 明年人家再闹你怎么加？ 人家99.7%都是exceed
expectation 的review。 你每年得加多少。 俺们公司如果是Exceed的review，全公司
5%。 这里基本上都是名校的BA或者Master。 |

2月1号周三晚上6时在洛杉矶到旧金山之间的1号高速公路上被警察拦下来
当时天全黑了，路比较直，路上都没车，又赶时间就没注意开快了
路上限速是55，因为黑夜看不清楚，警察写我开了110 （当时速度表应该是接近
100mile）
罚单具体内容: 22348(B) VC Exceed 100MPH I (Infraction, 还有一个选项是
misdemeanor)
要我2月29日去 SLO(San Luis Obispo) Superior Court上庭
罚单上也没写明罚款数额
2. 我的情况是：
我拿的是中国驾照（有一些英文翻译），租的Hertz的车，自己没有车。警察让我出示
了我的中国驾照，也没有记录无证驾驶。也没有要求我出示护照。我拿的是L1签证，没
有绿卡或者保险。之前开车三年，在美国开车加起来14个月，从没有出过事故或者不良
记录。
我当时一再跟警察求情，说我不了解这里的法律，请他放了我，但是警察还是不理会，
