本人情况：
2006年入美F1, 08年OPT -> H1B, H1B 10月1日生效。
08年结婚, LP 2007年入美，至今F1， 无SSN。
我的理解是，我必须先file extention，使09年H1B天数>183天, 用fisrt year choice
， 使得我08年10月1日-12月31日是resident. 这样我LP 可以按 Nonresident Spouse
Treated as a Resident 和我一起填 joint return "for an entire year 2008".
这种情况我要有两个statement：一个声明我用first year choice， 另一个声明我LP
和我一起按resident填joint return.
不知道我的理解对不对？
还是我哪怕file extention 还是要按pub519 里第六章 dual status填？
还有问题是如果我和LP按resident joint return填，是不是就没有5000 treaty?

余，终未果，沮丧之极。考虑到在现在的公司半死不活地混日子，白痴一样苦等经济复
苏重振 job market到猴年马月去实在不是办法，打算今年秋天之前暂时先回国。不知
道是否应该还让公司给file Extention／Renewal？具体问题如下：
１. 不让公司file，干到H1b第一个三年结束自动expire，领到最后一张paycheck走人
。这种情况下，将来这个expire的H1b名额还算俺的吗？假如若干年后俺再来美工作，
还要重新申请当年的名额，还是可以直接用剩下的第二个三年？
２. 不让公司file，不等H1b第一个三年结束提前走人。这种情况下这个H1b名额应该还
算俺的对吧？问题是假如若干年后俺再来美工作，新的公司首先要替俺file H1b
transfer，然后半年之内又马上要file H1b Extention ／ Renewal？这么麻烦怕会对
将来找工作不利。俺能到时候能跳过第一个三年的最后半年直接用这第二个三年吗？

不是问题的情况下，直接办EXTENTION是最好的方法，绕开CBP。不过只要一出境，再入

假设OPT的EAD过期了，H1b的receipt还没收到，是否不能工作了？那公司的pay check
上面是否不能领过期这段时间的工资？要当做unpaid leave来算吗？ 之前听说过，
可以把这段时间的工资放到后面来领。。。
另外，很早之前另外一个公司那里，提交了OPT extention 的申请，可是一直没有
approved，还在review 阶段，那是否可以用这个OPT extention的receipt来自动续期
EAD呢？就是180天的情况。。。

international office的最大的负责人开出来的document，我现在所在的单位是 一个
很出名的州立大学， 很正规的，所有的材料都是有学校的公章， 不然我自己也不敢啊
。 上面明确说明了，我可以继续工作的时间期限， 以及工资paycheck情况都照旧。
不过大蜜蜂说的也是对的， 不要轻易冒险， 而且一定要得到用人单位相关部门的认可
， 如果他们说行才做， 不行就不要勉强。
还有一点， 也许我是因为opt extention才可以那么长的gap. |

LD两个月前开始OPT extention。不幸同时也没了工作。申请延期的时候还有，所以延
期也正常下来了。现在挂在一个小公司，没工资。最近准备485. 那应该是写有工作还
是没工作呢？有工作的话，万一面试要工作证明之类的就麻烦了。可是要是写没工作的
话，那么在485pending状态下（几个月一年），总不能一直是没工作状态把。OPT 不容
许太长时间的unemployment. 另外，要是485不幸悲剧的话，那这么长时间的OPT 没工
作，肯定不行。会不会就直接illegal了。总的来说这种OPT-extention下的没工作挂靠
，应该怎么来填485呢？
还有各一个问题。当初念书的时候坐邮轮去墨西哥。I94上有出境记录，没有回程记录
。所以在I94的travel history里面就有两个连着的departure。之间相隔两年。这个
bug需要fix吗？会造成啥问题吗？这个要怎么fix呢？
请大神们指点一下，实在是不能出乱子了。 |

你现在就是找到挂靠的猥琐中国公司，你在法律上是为中国公司工作。你就自动不能在
现在公司上班了！
至于如何找这类公司，你可以去jobhunting版问问，基本上都要出点钱。
我给你的2条路都是有道理的。
1.你现在找好下家（帮忙办extention的），然后等这边差不多了，quit掉，等新opt，
同时积极找工作。
2.直接新工作，file extented。然后新公司在帮你h1b。
其三，我说一句题外话。如果你认真找过工作，并且没有公司愿意sponsor h1b，并且
你觉得将来也不大可能会有。
你想在美国混的，除了外发，就是嫁人了。
说句心里话，像我们这种任何类型公司都需要的工种，到头来想要换一个都不容易，女
人弄得压力太大，最后竹篮打水，不值得。

他说所以可以做7 year arm, 但是需要exception, 就需要二级underwriter批。 据他
说他做的loan有一半都是extention, 但我的agent说不可能这么多， credit差的人才
需要extention, 我的credit很好， 应该不需要。 另外我不明白为什么30 years
fixed要比7 years arm好申请？ 因为30 years fix的monthly mortgage payment要比7
years arm的高， 所以按理说应该7 years arm的好申请？ |
