USCIS Reaches FY 2015 H-1B Cap
Release Date: April 10, 2014
WASHINGTON—U.S. Citizenship and Immigration Services (USCIS) announced on
April 7 that it has received a sufficient number of H-1B petitions to reach
the statutory cap of 65,000 visas for fiscal year (FY) 2015. USCIS has also
received more than the limit of 20,000 H-1B petitions filed under the
advanced degree exemption.

During FY 2009 and FY 2010, usage of family-based visas has been
exceptionally low, especially among spouses and children of green card
holders (the F-2A preference category). In FY 2009, approximately 10,000
family-based visas were unused and, by statute, were reallocated for use
by employment-based immigrants in FY 2010.
Given FY 2009 underutilization of family-based visas, the CIS Ombudsman

发帖数: 2769 | 10 美国的立法、行政与司法确实是相互独立的，但也不意味着司法的权限无限大，能随意
干涉立法与行政。
EB3C原告的主张之一是通过诉讼实现recapture，要求“补回往年浪费的名额”。但是
visa名额分配的规则是国会制定的，如果在后面的年份补回可以实现，势必在该年超过
7%的限制，法院不能强制行政违法。如果原告要求的补偿根本无法实现，那么驳回原告
相应的诉求也就是可以理解的了。
虽然官司败诉了，但如果观察 EB3C 批准数据，奥本过去 3 年刚好把 EB3C 过去 5 年
应得的名额微妙地“平衡”回来了。（EB3C 每年应得的名额是2503）。至于奥本行为
是否与官司有相关性，我们不得而知。

明年的财政案里，对教育部门将大幅削减资金。加上已经实施的sequestration, 总共

On November 22, 2011, USCIS received a sufficient number of petitions to
reach the statutory cap for FY 2012. USCIS also received more than 20,000 H
-1B petitions on behalf of persons exempt from the cap under the advanced
degree exemption as of October 19, 2011. USCIS will reject cap-subject
petitions for new H-1B specialty occupation workers seeking an employment
start date in FY 2012 that are received after November 22, 2011.

发帖数: 1139 | 44 太佩服DOL了,一年之后才公布上一年的PERM report. 2010年的PERM不知道啥时候出来呢. 中国EB2靠自己的名额，还是要等不少年（别忘了算NIW和家属），只有寄希望于剩余名额了。不过O经常说ROW的demand很多, where? 不明白...另外,现在EB1的新政策出台,预计EB1的剩余会增加...所以还是该看好今明两年的剩余名额的...
引用报告里的一段话：“In FY 2008, there was a 42 percent decrease from FY2007 in cases certified. In FY 2009, there were 29,502 cases certified representing a 40 percent decrease from the number of cases certified in FY 2008.” 不知道FY 2010是不是会再少40%...感觉我们这个领域，对于需要sponsor身份的来说，今年Job Market比去年还差（不过软工硬工们觉得比去年好些了）。

There are only one positive: ROW EB2 leftover: FY 2009 PERM (ROW) only has 16000 (EB2/EB3). FY 2008 is 35000, FY 2007 is 60000+. FY 2010 PERM has not been published yet, very possibly between 16000 and 35000. So it may have large ROW EB2 left for spillover. |

quarter of FY 2012. It may stick to one date for several months before
retrogression. I have explained why last week. The newly submitted cases
will not be ready for approval in the first quarter of FY 2012. It takes 3-4
months to get ready.
If you look at the Philippine FB4 date movement, you will have some ideas.
Currently PH FB4 is in 1988.
