On November 22, 2011, USCIS received a sufficient number of petitions to
reach the statutory cap for FY 2012. USCIS also received more than 20,000 H
-1B petitions on behalf of persons exempt from the cap under the advanced
degree exemption as of October 19, 2011. USCIS will reject cap-subject

发帖数: 3537 | 8 今天一天心情都很烦躁，原因是今天是我EB2的PD。
看了一下2010年10月1日的485 PENDING 数据，跟2009年的比较了一下，估算出EB2I大
概拿了15000 剩余名额。EB2C 有大牛报道是拿了6550个名额，也就是拿了3700 剩余名
额。这么说了2010 FY大概是19000 ROW SPILLOVER。中间还包括了16000左右2009
FAMILY的剩余名额，2010年EB总额是156000多。这么算下来，光EB自己只有3000左右剩
余。
如果2011年跟2010 一样，但是因为没有了FAMILY SPILLOVER，那剩余名额也就3000左
右。这跟本版以前推测相差很大。另外跟以前说的大小年倒比较符合。
希望我的推测是错误的，那样明年夏天就有希望。不然就得再多等将近9个月时间了。
大家讨论一下，情况是否真是不乐观？ |

发帖数: 3537 | 9 是不是说 2010FY 的ROW EB2可能是2008年或更早的PERM，所以数量还是不少。但到
2011FY，EB2 ROW在2010 和2009 PERM很少，所以2011FY 485也就很少。希望情况确实
是这样乐观。
不过由于EB3I的PORT存在，对EB2C能得到的剩余名额还是很不确定。即使没有PORT，剩
余名额要在15000以上，2011 FY才能清空2006年的EB2CI。 |

totally we need 25k visa numbers in order to reach 2008. Things don't look
too great. We will be lucky if we can reach 2008.01 in the FY 2012.
With the reform of EB5 and new EB2 category, things look very bad. This year
we got 28k SOFAD, I doubt we can get 20k SOFAD in the next FY.

邮寄出去.这样PD2008比PD2009的RD还晚.
而前面有牛人(Oany??)考证过,USICS批准以RD为准,非PD.这样包括偶在内的PD08就要等
PD09批下来先了.TNND公司/律师啊!!!
当然这个以RD为准来批的看法还是值得商榷的.因为如果排期倒退到PD2009中,那2月才

TECHNOLOGY SOLUTIONS US CORPORATION 的公司，FY 2013 前两季度有动作的111个
PERM
，所有受益人均为印度籍。这些申请中的绝大多数都被据了或主动撤了。 |

2015.10-2016.2：EB3二排一直是01OCT13
2016.3-9：EB3二排是01MAY15,但是已经不honor了
EB3二排在FY 2017前进到01MAY14，就不再honor
2017.4： EB3进到01SEP15，但是不honor了
所以历史来看，EB3二排在honor期间，一个财年的进度也就是葱01OCT13到01MAY14，7
个月的PD前进而已。
假设FY 2018开始的时候，EB3二排是以01SEP14来开场（这也是一个乐观的估计，
01FEB14开场也有可能），假设前进7个月，最多就是进到01APR15.
再然后，就是等FY2019咯。
当然了，二排这东西才搞过三次（？），不能说上面就是规律了。

approval data. It then made all EB's from China aggravated due to the fact
that EB2C only got less than 3000 quotas whereas EB2I got more than 10000
quotas.
Is DOS afraid of publishing the data for FY 2010? Or they are on purpose to

oct， 成立了个网站，自己开始忽悠。他估计2010 FY, 最保守可以到2006年11月，最
乐观到2007年3月。结果，2006年11月的PD, 今年7月才到。误差将近一年。 |

According to our posting of 01/04/2012, in FY 2011, the USCIS received only
78,303 new EB-485 applications all together. Considering the fact that EB-
485 takes about 85% of total annual EB visa numbers (other than a small
number which are used by the visa posts outside of the country for immigrant
visa proceedings taking about 15% of the total numbers), indeed, the rate
of new filings for EB-485 was low.
