Today, U.S. District Court Judge Joseph L. Tauro ruled that Section 3 of the
Defense of Marriage Act (DOMA) is unconstitutional with respect to claims
brought by seven married same-sex couples and three widowers from
Massachusetts. Under the ruling, the plaintiffs are entitled to the same
federal spousal benefits and protections as every other married couple.

权力，也因此损害了联邦的法律权力。只有州政府有权力定义该州的人是否结婚。
-换名话说，国会越界地制定了该法律--这在美国历史上是首次--联邦政府可以决定什
么人的婚姻不合 |

现在为止，还没有暂停执行的决定。但是预期周五，联邦政府会要求申请判决暂停执行
。也就是说事情会停留在判决前的状态：联邦还不会承认同性婚姻。这些案件可能会同
时面对法庭。
如果两件案件的至少一位原告（同性恋一方）在波士顿的联邦第一区的上诉法庭胜诉，
那么DOMA很可能会在该区废止：massachusetts, new hampshire, Maine, Rhode
Island and Puerto Rico。也就是说，新罕朴舍的同性伴侣也会得到联邦的承认。
为Gill辩护的Mary Bonauto说，“如果我们在第一区获胜，就可能是DOMA彻底完蛋的时
候了。”
到那时候，国会可能会决定废止DOMA的那一章。如果他们决定不废除，那就可能会上最
高法院。GLAD的律师预期，在2012年初的上诉法院作出最后判决。

法律违宪，本次裁决维持了地方法庭两年前的原判。
星期三的裁决是就佛罗里达州政府儿童与家庭事务部提出的上诉而作出。佛罗里达
州居民、男同性恋者弗兰克-马丁-吉尔（Frank Martin Gill）曾向政府机构申请领养
两个男孩，但政府以本州法律禁止同性恋者领养孩子为由拒绝了吉尔的申请，吉尔和同
性恋伴侣后来将政府机构告上法庭，初级法庭在2008年裁决吉尔胜诉。
儿童与家庭事务部将吉尔的领养案子上诉到地区上诉法庭。在上诉理由中，儿童与
家庭事务部认为孩子由同性恋者领养“可能存在风险”，“风险”包括同性恋家长抚养
的孩子“可能有更活跃的性行为”、“可能受到更多的外来嘲笑和欺侮”。
位于迈阿密的上诉法庭在本周的裁决中认为，根据佛罗里达州的法律，有关机构在
评估领养人资格时应以儿童的最佳利益为考量原则，而州政府机构的证据没有说服力，
政府聘请的专家的证词缺乏科学根据，禁止同性恋者领养孩子的法律缺乏合理理由、违

聯邦一級DOMA仍有效，那麼聯邦的福利還是沒有。

US district court是聯邦法院的審議庭，每個州至少一個，
有些州大點兒，可以分東西南北中幾個區。
然後可上訴至us court of appeals, 上訴庭有12個大區，
也稱作12 circuits。

circuits的由來，是建國初期法官不夠用，所以各地巡迴。
要說建國初當法官可真不是好差事，又費腦又奔波。
巡迴法院之後就是上訴最高法院。
目前第一巡迴法院審理的幾個麻州案包括Gill v.OPM ，
已經送往最高法院等待審理。
上次在微博上看到我關注的幾個國內的法學人士，
談及最高法院就同性婚姻的討論有望在大選前出結果，
幾個人認為這事兒最高法院通過的可能性不大，
甚至把大法官的宗教背景都揪出來談，
也不知道是國內的法學人士不了解情況，

巨富税 = 仇富税？
有人将巨富税称之为“仇富税”这是当年法国前左派总统密特朗时期法国政府制定的一
条法律，凡是资产超过75万欧元的法国家庭除了缴纳所得税外，还得额外交上一笔巨富
税。以后巨富税的门槛渐渐提高，现在的规定是资产超过130万欧元的家庭要交巨富税
。资产在130万至250万的家庭，巨富税比率为资产的0.75%。资产在250万至400万欧元
的家庭巨富税比率为资产的1%。 400万至760万为1.3%。760万至1650万比率为1.65%。
1650万以上为1.8%。
