demoralizing 这件事。但看完底下这段听证会的过程，我觉得这家伙脑袋有问题。

Gorsuch 这个意见或许从法律上来讲没错（其实未必，看看议员在 5:35 所引用的条文
），但有个词叫做 “法匠”，法匠就是拘泥于法律文字，脱离现实。Gorsuch 这个人
就是个法匠。
老残游记里说清官比贪官还可恨，大概就是这意思。当你拘泥于某些东西而忘记一些更
重要的东西时，你就已经脱离作为“人”的资格了。
我建议所有人看完以上的视频再说。
但我也同情 Gorsuch 一点点。因为很少有法官必须为他的判决辩护，被当众羞辱。只
不过这是他应付的代价，当他接受川普提名时，他就应该知道有这一天。事实上川普应
该已经 vet 过他，应该已经知道这官司会爆出来，所以他的回答其实是已经预先准备

第一，gorsuch提到了多数观点里认为operate的定义很模糊，但是gorsuch认为这个词

去公开评论法院系统，并没有说到Trump以及这个executive order，另外他是在和某个

今天媒体挖出Gorsuch十二年前写的文章，说要在参院确认提民的时候好好地拷问他这

大法官在文章里说，历史上和宪法相关的司法案子帮了人权支持者很多忙，最典型的就
是取消种族隔离的布朗一案。然而，左派现在越来越指望大法官，而不是民选官员和选
票，来推动他们的理想，同性恋结婚，安乐死和教育抵价券等等等。过分地依赖于法庭
来辩论社会议题对国家和司法都不好。立法过程中，在势均力敌的议题上，双方都要折
衷。然而大法官在判案的时候就不得不一定要分个高低输赢。现实社会里，很多社会议
题最好通过社会试验来测试好坏，法律条文和律师吵架都太虚。左派过分依赖于司法系
