整个case处理得很快,出乎我们预料。看到USCIS的邮件是下午六点左右,我正在和朋
友打电话,只看见LG跳着奔向我,非常高兴的向我展示USCIS的邮件,嘴里不停的唠叨
“这是不是真的?” 当我得知Approval后的瞬间,我并没有太多欣喜和出乎意料。这
几天一直在细细体味着这一年来的努力和辛苦,真觉得功夫不负有心人。以LG名义申请
,但是他工作很忙,我暂时没工作,整个过程我完成了90%。LG做事不急不慢,不感兴
趣的事不太上心,我又是个急性子。事后LG对我妈说:“知不知道这个过程我被LP骂了
多少?”闲话少说,言归正传。
LG 只是Master,共9篇文章,Claim 了Award, Contribution, Leading Role and
Authorship 并且基本按照我对LG的信心指数来排序的。推荐信一共9封,其中4封独立

我的背景:
EE/CS 16 journal/confernece papers
about 100 citations from 24 countries,
dataset requests from 15 countries
70+ reviews,
7 recommendation letters
1,TSC XM1172 是否是新人?我考古了一下,好像没人提到?
2,IO只就推荐信挑了毛病,说contribution 没有 of major significance, 根本没提
我提交的其他objective documentary evidence. 我可不可以找同样的推荐人重新写推
荐信,还是非得要不同推荐人的信?
3, 可能因为我提供的材料太多,IO好像没有仔细看。是否可以按照IO的要求重提一遍

个人情况如下:
美国soso学校PhD (Computational chemistry&Biophysics),现一所较top medical
school作postdoc。文章一作5篇(4篇英文,一偏JACS IF8),2作1篇。他引30+。
Invited book chapter 1 篇。审稿1篇(现增为5篇,全英文, IF2-5)。
决定找律师!先咨询了一个朋友极力推荐的律师,比较悲观,刚开始建议重办,但我不
希望浪费1年排期,才答应response。另外咨询了一个律师,比较乐观,认为是最近流
行的generic rfe,我case不是很弱,比较自信。

not mean no or little degree of influence. Do you have any publication? Do
these publications generate any citation? Then how many citations do you
have? If no or little citation, then has any entity applied your research to

邮件里说well written,但是打开看到comment,立刻没信心了。
律师要求我写
1. 我的work是如何influence其它人的。
我的case当然很弱,否则就EB1A了,就不觉得我的finding有influence其它人啊。我可
以吹自己的发现很重要,但是我没有证据啊,人家都不用。这个我咋改啊?
2. 我都是通过关系找的人做reference,律师要求至少2个cite我文章的人。
我一共才20几个citation,有1/3是中文的,1/2是以前做的跟现在没有任何关系,我
怎么找啊?剩下的,除了1个review,详细引用了我的文章,另外几个就是在
introduction或者后面的讨论里简单提了一下。我怎么找啊,愁死了,就这样也不能说
我做的influence人家啊。再加上我现在做的是去年才发的文章啊,看到的人本来就少。
郁闷死了,感觉没信心了。加上我没有award,没有honor,没有review,没信心了啊。

Claim 三项
文章:6月提交时12篇;现14篇 (IF 1-10不等)
引用:提交时总共79,其中69他引;现112,其中98他引。
审稿:提交时38,现52
三项都承认,但是不承认small percentage,具体NOID内容在本文最后。
求建议:
1. IO提到我提交的推荐信中有几封是当时申请NIW用过的,所以就没采用(尽管内容改
了,而且是重新签的字。)不过不管怎么说,IO已经认为推荐信没有说服力。关键是很
多信中只是提到引用了我的文章,没有说具体怎么用的,难有说服力。能用新的推荐信
来说服吗?发现最近有一两篇文章在引用我文章是提到采用了我的方法,但也没有具体
描述。这个作者的信是不是会更有说服力?
2. 引用倒是涨了一些,但大部分都是一片挂名(7作)的文章引用,也只有这篇能根据
ESI算上1%以上;还有另外一篇一作只能算是10%。这些percentage在上次提交时都没有
提,因为当时引用也没有那么多,在回复NOID时这两篇(特别是10%那个)都有必要提
一下吗?

刚收到律师的信说他收到了NOID。
我们单位是美国去年第一的医院,只给senior的researcher办EB1B. 律师说这还是第一
次收到NOID,说“ we have never gotten a response like this from a case like
this so we believe it is some kind of adjudicator error”.
这真是晴天霹雳啊。

it's my view that this strategy is mostly used for getting into a good state
school based on its in-state quota - so here in texas, for UT austin it's
the top 7% - you have a better chance of being in the top 7% at a lesser
school than a nationally ranked one. so if you are determined that you kids

Thanks, I didn't know Adam Bartos before. But I really liked his photos on
his website. He might not be a super star in the art world but his photos
are moving. I can definitely tell influence from Eggleston + some formalism.
So I found an interview of him by the bomb magazine. It seems there are
some overlap between his influence and mine. No wonder my photos reminded
you of his. (Of course I am still light years from his level.)
