找。

效果很好。所以想申请个patent. 问题是我是否应该把patent申请交给学校。我是两年
前来学校的，所以这个算法是来之前就做好的。有相关文件的日期作为证据。问题是学
校要求即使自己申请patent，也要上报说和学校无关(我想很多学校都这样吧)，而且要
department chair签字。担心这样会offend someone. 如果交给学校的话，inventor还
是自己，但是学校支配这个patent.想听听大家的建议。非常感谢。 |

也见过两个老板个50%，两个学生0%
想一想，如果没有你老板，你这个work有没有可能做得出来，从专利角度来说，谁写的
code一点关系也没有，你只是pair of hands，谁写的code可以拿一作，但是不能拿
inventor，IP看的是intellectual contribution
另外就是，千万别指望你这个能拿多少钱，心态要摆正，像你说的关系也不好搞僵，想
一想到底也没有可能大公司花几个million买你的东西，还是他们自己coder花几周几个
月就能搞定 |

institute 2 (in US) provides suggestions and guidance. When applying for
patent, is it reasonable that institute 1 owns the patent, though the patent
will still list the person in institute 2 as one of the inventors?
One concern would be whether this is ethical for the person in institute 2.

第二，你在博士期间发的文章，你和你的博士老板会是co-inventor。如果可以申请专
利并商业化，除非你老板和你签过合同放弃利益分享，老板应该和你分享利益所得。一
般来讲，利益分享与你和你老板的intellectual contribution 有关。 所以找你的博
士老板谈话之前尽量找出书面证据证明你的intellectual contribution。
第三， 如果你在美国，并且你的研究是政府资助的，你和你老板都不能自己申请专利
并商业化。法律规定你的博士研究成果属于你的博士就读学校。同样，你现在的研究成
果属于你的工作学校。你和你老板需要和学校的Technology Transger Office 联系。
学校的Technology Transger Office 会帮你们申请专利并决定利益分享的方式。 |

1.前面的同志说得对，一篇可能相当有impact的文章的共同一作，比一篇so so
的文章的一作，宝贵的多，尤其是你已经是AP的情况，你会发现未来有很多
东西比“一作”宝贵的多，难搞得多，比如citation，比如跟老板的关系。
2. 你老板看上去是个相当reasonable的人，根你把道理说得挺明白的了
如果你就势收兵，说点好话，他应该不会太记仇。但如果你要硬搞，很
可能你也争不到一作，也跟老板彻底掰。
3.patent不分排名，所有inventor一样地位。patent 99.9%都是浮云，
屁钱都挣不到，为了这个梦里的大饼，得罪两个人，值吗？
4.所谓proposal的考虑，更是全反。现在的情况完全不会阻碍你写
proposal,你就算是第八作者，也可以拿来写，只要你本身的idea
立得住。但是得罪了老板，未来对你的proposal只有坏处没有好处。

有一个创新性的想法是我提出来的，做仿真也得出了好结果。我请隔壁组的同学帮我做
了部分实验，基本上是只是用到他们组的仪器，我告诉他怎么做的。最终实验也做出了
好结果。本来应该皆大欢喜，但是有两件事感觉被老板给卖了：
准备申请专利的时候，老板想把其他组帮忙做实验人也加到inventor list里。我认为
专利保护idea，就算是错的idea也能申请专利，为什么要把“实验员”也加进来？
还有准备发表论文，老板想把我做的和另外一个师兄做的东西合并起来发表一篇论文，
然后署名equal contribution。那位师兄做的东西吧，数据是真的，理论解释我觉得是
错的，但是老板很信。如果分别发论文的话，肯定是我的东西更有影响力。
我很奇怪，老板为什么不想把credit给我？faculty都是怎么想的？ |

呢？在flcdatacenter察看湾区level 2的工资已经将近120K了，level 1也有将近100k
。另外这个工资是只计算base还是按照whole package计算呢？如果是后者，package中
一些不好估价的部分如何计算呢？谢谢。
如果要从level 2的话好高啊，一般research scientist好像有不少达不到这个数阿。
可是看精华区又说一般level 1没法办EAD。虽然公司说给办H1b给办绿卡，但是有点不
确定这个level，所以怕被忽悠了，因此想请教下这个问题。谢谢。
