Those commentators always try to make things interesting. If you hit your
approaching shot in the water, you are in jeopardy to make a double bogey.
Meanwhile, if your play partner makes a birde, that's a three shots swing. It
could mean 7 stroke lead down to 4 stroke lead. But to say "diminish" is

首先指控罪名中"试图非法拥枪"不成立，可以申诉“诬告”。由此造成的损失可以在民
事法庭索赔。
再者整个过程中检察官的态度是认定你有罪，尽管法庭并没有定罪。而且burden of
proof是检方的责任，而这个案子整个过程中却是嫂子努力证明你没有违反任何法律。

如果这个案子是被法官dismiss掉的话，反诉也就是为了出一口气外加将应该属于自己
的赔偿索回来；不反诉也没什么，因为检方受double jeopardy的限制，不可能轻易重
新启动刑事诉讼的程序。但是现在的问题是case was dropped by prosecution，这个

对枪支和枪支使用的意识倾向。
但有人拿枪不请自入进你院子或家中，常人会认为你那时操枪是为了保护财产吗？几步
之遥枪口对着你时(这事只有你和对方两个人说得清)，Ability, Opportunity,
Jeopardy缺了哪个条件不能开枪呀？
开枪自卫打死对方，警察不逮捕，检察官不起诉的clear cut cases不是没有，在家发
生的更容易倾向于对户主有利。
还有就是使用武力保护财产一说在和平时期获得的认同度不高，有些属于灰色地带，但
在非常时期比如动乱洗劫等，使用武力保护财产往往是保障自我生存的必要手段。
至于工作申请等表格哪些要填，哪些不用填，哪些你想填也找不到地方给你填就不用多
说了。

另外，castle doctrine, stand your ground, 没有duty to retreat，还有一些州法
律保护刑事罪名不成立的自卫被告免受相关的民事诉讼等等这些都是解除大家对法律麻
烦的顾忌，而能有效及时地保护自己。这些法律不会也被认为是鼓励trigger happy吧？
可能的法律后果，自卫条件底线，被迫开枪后如何和警方沟通，如果遇到对自卫开枪有
保留意见的地区检察官如何处理，是否有自己刑事/自卫律师等等很多问题早就在把枪
挂在身上时想好甚至演练几遍也不为过。一辈子真要用上一次，不紧张到六神无主，枪
不打偏，自己能活下来就是重大胜利了。到时候还想歹徒踢坏的窗子要花多少钱修，请
律师要用多少钱，no guilty / manslaughter / n degree murder判决各要造成多少经
济损失，民事诉讼败诉又要多少开销，你就永远躺倒慢慢想着吧，至少人寿保险可以兑

根据double jeopardy，这老头应该不能再受相同或类似罪名的起诉。除非当时DA只用

好关系与陪审团的结论没有什么关系。不过事发区的DA倾向和反对武力自卫的，不管结
果如何(还是陪审团定)差别还是很大的。
提起德州老头Joe Horn这事，不是评论他的做法，而是指出不同地区的民风对武力自卫
的看法不同，而这种不同看法很明显会产生巨大差异的结局。这老头要是在Oklahoma干

和Casey Anthony的案子类似， 种种条件和环境证据都指向被告。但美国法律就这样，

1) 选高级现代教练的一般都是动作派的，对动作是否标准很在意。这种初学者
平均来讲野心比较大，花的成本更多，也更急迫的想看到进步。这样的性格导致
更高的辍学率。一旦比赛成绩进步不够迅速或者停滞不前，就会导致失落，随之
产生quit的念头。一旦quit, 就永远达不到3.5了。相对的派系是请老头教练的
和不请教练的。
2）选高级教练的另一个问题是动作进步得太快，很快就会像模像样，进度大大超过
请老教练和不请教练的。这样就会导致一种false confidence. 殊不知教练在更正
动作的同时，绝不可能自毁长城的提到“练习中动作正确跟比赛中能用的出来完全
是两码事；你现在击球稳定漂亮的主要原因是偶在喂你球；要想比赛中也能足够高
成功率的用出来，你至少还得上偶10倍多的课”等等。这种false comfidence是
危险的，一旦bubble被老油条捅破，可能就导致了denial，quit. 这样也达不到
3.5了。
3）动作派的一个问题就是没有妥协动作的思维方式。在低等级比赛中，能产生
