这个事情是这样的……
网络写手刘某某，笔名“天一”，写了本名叫《攻占》的耽美小说，并拿来印刷贩卖了
7000册，从中盈利了十几万。刘某某撰写的小说《攻占》
所谓的“耽美小说”，相信很多年轻的盆友都知道，是以刻画描写男性之间的爱情为主
的。
但“男性爱情”本身不是这次的重点。重点在于，天一的小说里含有大量淫秽色情的描
写……
2017年，一本名叫《攻占》的书籍突然在网络上火爆起来，短短几个月时间，该书籍就
通过网络销售数千本。而这样一本“畅销书”也引起了国家扫黄打非办的注意。经国家
新闻出版广电总局出版产品质量监督检测中心鉴定，鉴定样本《攻占》为淫秽出版物。
办理此案的芜湖县公安局治安大队民警朱佩告诉记者，《攻占》是一本淫亵性地具体描
写男男同性恋性行为的书籍，其中还充斥着大量与性变态有关的暴力、虐待、侮辱等行

01 美国法律凭什么管外国人？
外国人在美国领土外的犯罪，美国政府有权管吗？
答案是肯定的：有权管。那么这是否可以看作某种形式的霸权主义呢？
没有比较，就看不清问题，请看《中华人民共和国刑法》第八条的规定：
【外国人在中华人民共和国领域外对中华人民共和国国家或者公民犯罪，而按本法规定
的最低刑为三年以上有期徒刑的，可以适用本法，但是按照犯罪地的法律不受处罚的除
外。】
可见，中国法律也有类似的规定。事实上，不光是中国和美国这样的超级大国，一般的
国家都会把自己国家的司法权延伸到境外。原因有二：
第一，刑事司法权是一个国家主权的一部分，没有国家愿意轻易放弃掉一部分主权。实
际上能不能做到很难说，但如果主动放弃司法权，那就有【丧权辱国】嫌疑了。
第二，保护本国利益的需要。比如一个外籍毒贩子，在中国境外生产毒品，但主要卖给
中国，现在这个毒贩子偷偷潜入中国境内被中国警方抓获。这时候，如果中国《刑法》
没有刚刚引用的第八条，那么按照法律，就只好释放毒贩子，这岂不荒唐！
因此，所谓【长臂管辖】并非美国所独有，而是国际上的通行做法。

国家（sovereign state）对属地/“下位国”/地方政府是如何管理的。所有“上位”
的主权国家都需要保证对属地的控制，所以，主权国家与地方政府关系就是授予权力的
关系，并且通常会做出权衡取舍（trade-off）。简单地说，就是如果给了你某些权力
