单的旋律，加上一段比较怪异吸引听觉的创造，听一遍挺新鲜，听二三遍就腻歪了。估

中文“罪”字是从“冈”（即网）及“非”二字组成，意说非分之事必构成网罗，如天
罗地网般，把整个人类罩在其中。罪是天下第一号刽子手，它扼杀了人生的幸福，它将
人致死地而后快。人在罪面前似毫无抵抗的能力，是以世上古今中外的哲人皆承认罪的
权能，如罗马古哲学家辛尼加（Senaca）谓：“世人都有罪，或多或少”；另一罗马哲

昨天我讀了一篇19世紀遁道會的神學家John Miley 寫的駁斥有限救贖論的研究論文。
我現在來試圖翻譯這個救贖論的觀念，因爲在網上找不到有關的中文討論。有些神學辯
論華人教會似乎一向不怎麽參與，所有的辯論，我們華人信徒可能常常會感到不得要領
，聼起來似乎都有些道理嘛。因爲你會注意到，這個救贖論的研討都是集中在個人層面
上的：圍繞著選民個人的被選、個人的罪得赦免和得救，而華人的文化卻是把焦點放在
群體和關係方面的，研究個體事物的屬性不是我們的擅長。

述邪恶？良善和邪恶的差别在哪里？
古典基督教哲学家奥古斯丁和阿奎那（Saim Thomas Aquinas），都绞尽脑汁想着解决
关于邪恶的问题。虽然他们用的哲学方法截然不同，但是他们对邪恶的本质，有同样的
想法。因着他们的影响，学者就建构了关于邪恶的基本假设。
在传统中，邪恶的定义是从拉丁文negatio（否定）和privatio（缺乏）而来。也就是
说，否定和缺乏是邪恶的核心意义。否定是指，从负面角度来解释邪恶。我们来看看这
几个词，不公平、不敬虔、不道德、不顺服、无信仰、敌基督。这些词都以否定的字开
头（例如：不、无），后面加上正面的词（例如：公平），来表达负面的意义。要了解
这些词的意义，都必须先了解其中正面意义的词。要了解什么是不公平，就必须先知道
什么是公平。要明白“不人道”，就必须先了解什么是“人道”。从这些用词就可以看
出，大家对邪恶的想法、对邪恶的认知，必须以良善为理解的基础。我们必须从良善的
反面，才能了解邪恶。如此看来，邪恶是从属的，是附带的，必须仰赖我们对良善的认

式发展。中国铁路总公司运营的高铁里程，占据全球高铁总里程的 60％以上，中国中

have one. To argue with and insult people on a bbs is the only life he knows
of. He has been a complete joke on the strait board. So this lawless board
gives him a perfect resort to retreat to.

government, not on the freedom of the people.
This is a classic freedom of speech case. The cross burning case is about
whether government can regulate conduct that may be treated as a symbolic
speech. Here, there is no action, just pure speech. It may be shocking to

1. 有没有伤害和有没有standing是法律问题，不是你觉得受冒犯就有法律承认的伤害
。消费者集体诉讼那都是有明确的身体或经济伤害的。
2.你引用的那段联合国文件是联大的一份report中关于Internet上言论自由的
recommendation，没有任何法律约束力。
即使是美国总统签署，参议院批准的国际条约，在美国国内也只有普通联邦法律的地位
。如果这样的国际条约与美国宪法抵触，同样是无效的。
另外很多人讨论第一修正案言论自由的标准时说什么imminent danger。imminent
danger本身不是第一修正案法律中使用的词语，通常imminent danger是用来描述正当
防卫的条件之一。
第一修正案判例法中曾经使用过的一个标准叫clear and present danger，但这已经是
过时的法律了，现在通常引用的标准是 brandenburg v. ohio 中提出的标准：

有雇佣关系才能诉讼”了？其他特殊法律关系确实包括服务关系，但是被告必须要是
public accomodations。什么叫public accommodations？我也引用一回wikipedia：
