is the new trend from USCIS that they fill the RD as the PD for dependent.
So nothing to worry about it for now. |

Only the minimum required docs, plus EVL (which is not listed
as required either on I-485 form).

send them another copy. It doesn't matter yourself or laywer to respond the
RFE.

糊涂没看过）。 他只是找可能的因素， 说用master 来做理由，不过也confirm了我当
时的title。如果你开始没有master，上班后才有了，是不是更好呢？
过程好像很简单，就是重新交了个140 的表，用原来的perm 的PD，laywer没有要任何
新东西，只是重填了表，我签了字。 |

Found laywer filed as EB3 by mistake after got 140 approval. Changed to EB2
with same PD 06/2009. Filed 485 last year. Received card as a suprise last
month. Spouse got the card at the same time.
Rarely checked status after filling 485. Life is such an interesting journey
.
To answer the question you might have:
I've received 140 approval for EB2 a few years back and filed 485 last
spring with EB2 priority date.

1, For this EB3 downgrade, are we going to go through the whole PERM process
to get a new PERM, or are we going to just use our previous PERM approval(
EB2)?

1， No, we won’t need to redo the whole PERM process. We are going to use
the old PERM approval and just file an Amended I-140 petition.
2， Even though we could file concurrently, I would debate whether we should
or not due to the complexity. I might just do I-140 first and get it
approved. Allowing premium processing is questionable.
3， It might possibly be rejected as any case would be, but there is law and
USCIS memos allowing us to submit an amended petition requesting a

两个140必须有两个PERM。所以，需要走PERM程序，搞一个新的140.两个140并存。
所谓的AMENDMENT， 就是利用180 DAY RULE,基于老的，过期的PERM,直接在现有EB2
140做AMENDMENT,替换掉现有EB2 140为EB3 140.当然，EB3真倒退了，还是可以同样
AMEND回去EB2，链接EB2的PD。
所以代价就是律师费。如果排期在一年多以上，这么折腾也不算浪费时间，来回折腾就
是一年。

regresses, we might have to file a new 140 to switch back to EB2. But he
said we do not specifically amend the old I140. I don't know if this is
doable. |

I am composing a letter to USCIS to point out the misleading information
provided by AILA to its memebers. EB2er may be adversley affected.
However, if your laywer is a member of AILA and actually used the amendment
to
switch classification (not both eb2 and eb3 as indicated by AILA memo),
then we shall see the true benfit and risk associated with it. |

的G28就没有那一项， representative要么是lawyer or laywer student or
accredited representative, 这个accredited representative不知道是怎么确定的。

发帖数: 102 | 45 这个要具体问题具体分析。一般来说，如果JD里面的主要内容没有变化，是不需要重新
发perm的。对于申请没有影响。看你的描述，你基本应该符合这种条件。但是你做的项
目对于技术的要求如果改变很多也有可能需要重新发perm的。这个具体要你们公司的
laywer来看了。
还有一个就是job location又没有改变。据我所知，如果跨洲的话也要重新做perm。 |

asked to get a new visa stamp from china so everything works out. the laywer
told me if the gap is less than 1 month, it has a better chance of no need
to go back to china |

USCIS already has your petition queued for adjudication as your priority
date becomes current. We will let USCIS know that your priority date is
current, but this will not typically result in faster adjudication.
Additionally, we will let USCIS know that the wrong category was listed but
they typically do not take action based on these notes (the officer usually
addresses these issues through a request for evidence if needed). We will
keep you posted.

fellow Chinese.
Right now USCIS is processing cases filed before 10/24/2014, so cases filed
this June won't expect a decision till Jan 2016 with current rate of
processing, however it might change depending number of cases USCIS received
.
The law firm will contact service center directly. Contacing senator is an
action that is taken if no response from USCIS within normal processing time
after law firm's inquiry.
