we were pre-approved for mortgage loan at citi bank.
but now a loan agent is telling me that she couldn't get my loan because my
OPT status, even though I just had my new H1B approved (OPT and H1B under
the same employer).
Is this true? Anyone knows. Urgently need help!!!

GFE不是loan commitment, GFE是在loan正式开始申请的时候disclose给客人的收费估
算表。正式的GFE是把客人的信息输入系统之后,自动生成的一份文件。如果只是shop
around,LZ只需要问清楚note rate,有没有point,和银行收费就可以了。并不需要
GFE来做比较的。
loan commitment是审批通过之后lender才会issue的,与GFE是不同的文件,基本没有
关系。

还是有很多因素可以影响到rate的,比如LTV,loan amount,impound等等,PF有时一天
会有0.25的adjust,所以最好的办法就是把doc准备好,请loan agent帮你在一天之中最
好的时机来锁。对一个400K的loan来说, 0.25就是1K的rebate

不会有任何影响, 因为credit report 查不出来喔。我去年借过
“另外还有一个贷款问题,为了付20%首付+closing cost, 刚从 retirement plan 里借
了两万。这个还是要还的,有点相当于一个小的secondary loan, 不知道这个会不会影

If your loan amount is $600K (<=$$625.5K) in some counties in CA, this is
regarded as jumbo conforming loan, which GSE (Government Sponsored
Enterprise, namely Fannie Mae, Freddie Mac) may buy and hold your loan
principle.
Counties with $625.5K limit: Los Angeles, Orange, Santa Clara, San Francisco
, San Mateo, but not San Diego, etc) after Oct 1.

banks normally would not make mistakes on this as this is very standard
procedures.
Depending on your old amortization schedule, your loan terms will be
shortened and your last payment amount will be changed because the tail will
be adjusted to ensure your early pay towards principle is reflected.
Give an extreme case. If you pay $10, for most of loan, the loan term will
stay same. But your last payment will be changed due to early pay although
the amount is little.

Some lender have extra "penalty" for loan <= $200K.
For No Point No Fee refinancing, the lender will give you rebate to cover
your closing cost in terms of fixed percentage instead of fixed amount,
whereas the closing cost has no significant difference between $200K and $
400K loan.

Those loans are probably underwritten by the bank and hold as their
portfolio instead of repackage and sell through secondary market.
Usually loan ready to sell through secondary market has to conform wth Fannie Mae rules and can get better rate. Loan not sell through secondary market may have loose application criteria and easy to get approved based on bank's underwriting rules, usually more flexible than the Fannie Mae rules.

loan processor是broker的人,通过agent收集你的材料,把你的信息输入做loan的
system. 同时和underwriter打交道.
unerwriter是lender的人, 所谓的审核大员,掌握loan的生杀大权。

大银行里面的loan officer不是从头管到脚的,他们拉近loan来之后就不管了,具体的
paper work是processor在做。只有像我们这样correspondent lender里的loan
officer才不得不什么都管呢,就算有processor,跟客人联系的也是我们。

用一个mortgage broker做refinance两次了,觉得她的利率不是最好,还要自己交
appraisal fee。现在正在做第三次。材料已经更新签字交了上去。
现在和另一个mortgage broker联系上了,利率看起来要好一点,虽然他也没有给个准
确的数字。这个mortgage broker还把appraisal fee给cover了。
我想给第二个mortgage broker也交一份loan application,这样两家的利率就都不是
大约估摸出来的,就可以比较了。
可以给两个mortgage broker同时交loan application吗?如果用了一个,没有被用的
那一个有什么损失吗?loan应该还没有被originated。我知道broker要花20块钱查信用
分的。还有别的费用吗?

I am considering something similar. No loan agents would even bother to
prepare a pre-approval letter for you with 30K loan amount: they can not nor
bank can much money.
borrow from 401K is the best choice. and then try to pay back as soon as
possible later by salary or a loan from a private party.

realtor推荐的loan agent说我们应该有30年3.875%的rate。
原来当地最好的一个lender不再收H1b了(该lender可以有3.625%)。
请问还有什么办法可以找到更好的loan rate么
还有该loan agent说现在要25% downpay才能获得最好的rate了,不在是20%了,请问这
个靠谱么?

agent直接给的offer. loan officer也是那个agent 推荐的. 他们俩是buddy. 我跟一
个人说的话, 他们都未经我的同意, 立刻在5分钟之内让另外一个人知道.
今天刚做appraisal. 我就问那个agent,"是不是很多东西都要修". 因为房子被人闯入
过, 切割了铜水管还有带铜的导线. 肯定是有许多东西要修. 我是考虑如果很多东西都
要在close之前修,我就不买了,因为我也不确定我的loan是不是能批准.
agent说, 明天才能拿到apprasial. 我再问:"我们这个short sale的foreclosure date
是什么时候?". 那个agent一下子变得非常警觉, 问我为什么问这个问题?
不到半小时, loan officer给我们发email, 说appraisal已经做了. 这个周五下午就能
close. 让我们选择一个时间close. 我从来没有听说能这么快就close的. order

我们下offer时给的prequalification是A银行的conventional loan,卖家接受了offer
,我们想换成利率低很多的B银行,但B银行只给贷FHA loan。Buyer agent说我们要买
的房子不符合FHA loan的条件。请问是怎么回事?谢谢!

yes, he sent me the estimated closing statement, which I found the purchase
price was off for $20,000....it looks fine to me after he fixed it....
The other document he sent to me was called "notes", which includes the
property address, prepaid penalty, loan amount, morgage rate...but I didn't
see term, legal name and vesting...could you elaborate on a bit?
Do you mean if I could ensure things you mentioned above are correct, then
the chance of my loan got messed up is pretty small?

Yes.
BTW, your loan has "prepaid penalty"? All loan (in the past two years) I
originated never ever has prepaid penalty except you have to wait about 4
month before you could refinance or payoff.

如果rate和银行收费都没有问题的话,有些mistake是不影响loan的。而且,HUD也不是
broker出的,是lender或是title那边出的搞错的。不过,purchase price搞错的确实
不多见,除非purchase price在做loan过程中曾经修改过。。。

loan contingency在17内remove是加州的standard吗?我想选"loan contingency in
effect until designated loans are funded". 可是agent不同意。

Normally buyer just have default 17 day to remove loan contingency in CA.
Loan commitment letter could be obtained after your loan is approved (with
conditions). 21 calender days seems enough.

在75% LTV的前提下,loan越接近417K越有利。当然如果60% LTV,417K loan,信用成
绩740以上,基本就是最perfect了。
不过,其实rate也差不出很多,300K的loan已经不错了。

Thank you so much for your reply! We do want to move to the new place and
use it for primary residence. I contacted two lenders for the new loan and
told them my situation. One said no, and one said yes for the new loan. If I
do get a new loan approved and move to the new place, will I get an issue

这个才是正解,以前的lender可能会被investor要求买回之前的mortgage loan,因为
那个loan是secured by primary residence mortgage,而不是investment property;
前lender有几个选择:
1. 要求LZ将那个房子refinance成investment propert;
2. Report给FBI,因为现在anti-laundry law要求lender report suspicious
activity,毕竟LZ在签之前的1003的时候claim的就是primary residence;
3. 把退回来的loan卖给其他机构投资者。
LZ要是有心,可以把签字的文件拿出来看看,1003上面有很多责任的claim。

Let us make it simpley:
By rule, you can not get the loan.
Of course, if you want to take the chance, you can try. But you need to
consider the worst case scenario:
1. If lender figure it out ( most likely they will in your case due to the
recent refinance), you can just refinance your original primary to
investment with higher rate and close the current new purchase with primary
rate. But that make you loose the closing fee for the newly closed
refinance due to early payoff.

Thanks, Rainhard and blueangel! I contacted the loan broker that handled my
refinance. Surprisingly he told me that I can get a new loan with primary
residence rate as long as I choose a different lender for the new loan. Does
it mean it is doable?
If I sell my current house after I get the new one, would I be safe then?

下offer之前要把loan搞好才行。。一般惯例是这样么?可是搞loan难道不需要买的房

要做mortgage了,其中一个Loan officer信誓旦旦给出了最低利率,我们就与她签了约
,给了她我们的材料。但之后她又说不能保证那个利率,给了我们一个更高的利率。这
中间还有其他说谎的行为。我们无法再信任那个Loan officer,所以现在我们想找另一
个Loan officer办贷款。请问大家这样可以吗?谢谢!!!

做loan之前要先 appraisal ,这个可能要4,5百块,如果是loaner免费做这个,你可
以在inspection 之前就开始loan,否则还是等 inspection报告出来,没什么大问题决
定要房子再去做appraisal 和loan

问wells Fargo的人没用,high balance给LZ 3.25%???一定是有point又有cost的。
wells fargo都不用broker了,他们自己的公布的rate大都是有1个point的,而且,这
种银行从来没有no cost refi提供。
如果距离417K不远,就不如等一等找人做417K以内loan的refi。
LZ买房的时候拿到的3.75%,对于high balance来说,人家也没坑你。何必要搞得人家
没钱赚呢?
Recapture是指Wells Fargo会向之前给LZ做loan的公司,或者是broker追回所有
commission,如果LZ在6个月之内pay off掉现在这个loan。

又不是人家agent拿了你20的报酬,人家给你做loan当然要买credit report,买个
credit report就是要20刀,难道你要agent自己贴钱给你付?况且你最后不还要拿
rebate
么?
当然可以找银行做啊,银行不收你这20刀,但是银行给你更好rate?给你rebate?还是
要收你上千的手续费?
20刀那有这么不爽,还是放宽心好,这都是正常事情,跟agent问清楚就行
别人做refi还要自己先交几百的appraisal钱呢,要是除了问题做不了loan不也是白交
了,做事情总有投入和风险

离closing date的最后期限只剩20天了, 可是和loan agen发生了点问题。
这个loan agent是我买房agent 介绍的一个大银行的老美,最开始报价就有点高, 本
来不想用她的, 后来她又给我报了个低价,我考虑大银行审批应该较快, 所以就和她
继续合作了。
我现在有两笔credit: 1, seller credit $5000 towards closing cost
2, lender credit $5000 with higher interest rate
我打算用lender credit去付clsoing cost, 把seller credit 存到我在escrow的账户
用于将来支付property tax. 可是她不同意, 坚持先用seller credit付closing cost
, 这样我就基本拿不到lender credit了。 等于无形中损失了$5000.
我问过一个中国人的贷款经纪, 她可以按我的要求做。 不知现在这种情况我是否该换

I'm trying refinancing with Provident, it 's been more than 3 months, I'
still waiting. My broker told me that they just sent my application to
Quick Loans, since if provident can not approve my loan before November 8,
they will charge me 1% of loan amount, per Fannie Mae' new policy. Anybody
knows what the policy is? Many thanks!

举例来说,conforming loan, 30年,假设当rate是3.875%时,lender rebate是$3000,
而这个loan的cost是$2500, 这个loan就可以做no closing cost, no point. 同时还可以
拿回$500. 当rate是3.75%时, lender rebate是$2000, 不够cover $2500的cost, 这就
要交$500的closing cost,如果不想交, 就退而选3.875%.
要说明的是lender rebate和broker的commission是没有关系的.如果broker退您钱, 那
就是从commission里退的

要看combined LTV是多少了, 就是俩loan加起来的LTV,如果比较高的话,第二个loan
都未必拿得下来。80% first lien,另20% 2nd lien的时代已经过去了。

jumbo loan rate不是高, 但是条件比较严格,对cash reserve要求比较高
