直到上个世纪70年代，法国还曾是世界最富裕和强大的国家之一。但法国今天已经
被沉重的债务压得喘不过气来。国家总债务达18703亿欧元，占法国国内生产总值的91.
7%。人均负债高达66508欧元。法国经济被债务拖入衰退之中，长期失业人口突破300万
。法国前总理费永为了提醒法国舆论，曾在上台伊始公开表示：“我是一个已经破产的
国家的领导人……”
法国怎么会沦落至此？真的如法国主流学术界所说的是缘于“福利社会”，最终导
致今天的天文国债的出现？
这完全是一种蓄意误导，目的正是为了掩盖法国国家金融主权易手的令人惊心动魄
的事实。法国国家债务的根本原因，是由于法国在金融现代化改革的旗号下、在向英美

agency relationship 的託關係。Principal（你）託付 agent（他）在某件事情上代
表你的利益，他只能對一個人負責，不能對兩個人負責，尤其是利益衝突的兩方。所以
请一个律师不可行。（这里可能有人会有不同意见，我洗耳恭听。）
有人说各请一个律师，一共两个律师。这也不行，因为两个律师代表打赌两方的利益，
不是公正第三方，他们不能做裁决。
有人说找 escrow，这就有点像了。但是 Escrow 是行使一个双方同意的合约，所以你
们必须先有一个合约。这个合约因为没有定型化范本，比较麻烦，所以可以委由律师代
为协商，当然为了省钱，也可以自己来。
签约的时候，合约上必须载明签约人的姓名地址，签字必须公证。也就是说，这里隐私
是无法保密的。
或者，两人签一个协议（again，协议内容可以自己来，也可以请律师写），载明协议
人姓名地址、打赌条件、管辖法院等等。协议一旦两人完成签字，就对双方有 binding

我那天开车回Logan，然后到Logan的时候，有个警车跟着我跑，我当时就纳闷了，我又
没超速又没闯红灯啊什么的，干嘛跟我？然后警察告诉我：他的电脑里面显示到我的车
子没有上保！然后警察说我要去court和法官说清楚。
然后我打电话给保险公司问怎么回事，原来是我在买车之前，先买的保险，然后等我买
到车子了，我忘记和保险公司更新我车子的信息了，我只更新了我的驾照信息，之前以
为有了驾照信息保险公司会自动更新车子信息。所以我完全不知情，然后保险公司也不
能证明我在Pull over之前这个车子有上保，他们只能证明我买了auto保险。
重点是，我出庭那天，法官问我想证明自己guilty 还是 Not guilty,我选择了not
guilty.然后他就给我安排了一个pre-trail.应该就是一个mediation吧。
可是请问下各位：这种情况我应该怎么处理？我确实没办法证明我是not guilty.可是
在我买保险的时候，以为更新了驾照就OK了，这可以算我不知情吗？哎呀呀，我现在脑
子里面一塌糊涂，觉得自己好委屈！每个月都交了100多的保险，结果还要出这种事！

司。这个和身份无关。
大多数官司都是几百到几千美元，对方都有律师，有的时候我要的钱还不如对方律师收
的钱多。
所以基本上我的法院传票发给对方，对方立刻就软了，愿意和我讨论settlement。有的
公司在收到我传票之前牛哄哄的，非常rude。
打small claim court官司费用很小，一般100－400美元根据你要告的金额。最高金额
各州不一样，5000－10000美元。
大多数官司你就可以谈判解决，有的法院还会指定一个mediator，中间人来调解。
你需要时间，需要耐心，认真阅读文件，认真准备书面材料和证据，这些都不麻烦。 |
