在美国医疗事故的判例中有2点是很重要的：1. no trial has no risk, 就是说一个病
人不能指望治疗没有任何风险。 2.misconduct, 这个事故有没有misconduct,比如，有
没有病人的written consent等。一般NIH的trial,比如癌症的trial, complication死
的多了，大医院每周的clinical meeting主要就是讲这种case，多如牛毛，谁告赢了？
