发帖数: 4453 | 6 乱扯！ 美国是判例法法系，州法与联邦法管辖的范围不一样，很多法律联邦不涉及。
比方婚姻法，属于地方法，联邦压根就没有这法律。
如果官司打到联邦最高法院时，联邦最高法院的法官就要审理，而这时9个大法官审判
的结果就成了判例，这种判例就成了判例法，如果各州的相关法律与其反对，联邦的判
例法就会将其override.
但如果各州对判例不服气，也可以和联邦申诉或者打官司，最高法院自己推翻自己判决
的的例子有的事。另外，也可以通过各种国会议员提案立法，修法，搞成了也可以
override 或者overturn最高法院的判决。
另外，美国的国内法是高于国际法的。就是说，不管联邦还是州法，如果与美国以外的
法律包括国际法相抵制时，国内法高于国际法。 这就是美国的牛逼！ |

再说了， 那个chief 法官，Roberts， 还很年轻，一时半会走不了，而且从他的

教团体，个人，和各级的地方政府file case 挑战这一摧毁社会基本意识和人类本性的
法律。
大家还会看到，将会有国会议员从不同角度，以不同方式和方法提出不同的法案来修正
或者oveerturn这一法律。
或者，也许会看到最高法院的某位法官会被逼迫退休，然后任命另外的法官而让最高法
院自己修正那个法律。
最后通过哪条路完成实现override或者overturn的目的，现在还不知道，但斗争绝对不
会停止。

第一，最高法院没有立法的权利，最高法院只能对上诉的案件作出判决，而这个判决的
核心是宣布州议会立法禁止同性婚姻违宪。所以不会来“overturn”这一法律或是“修
正那个法律”
第二，最高法院上次被逼迫的情况还是保守派大法官们跟罗斯福总统对着干，结果罗斯
福总统威胁要增加法官人数来通过对总统施政有利的判决。还没听说哪个大法官会被逼
迫退休。另外目前是民主党总统，就算谁退休了，提名的还会是自由派大法官，于事无
补。
第三，以后的事情谁都说不准，当然有可能会有变化，目前保守派的唯一希望就是哪个
共和党候选人能击败希拉里，成为下一任美国总统，然后金斯伯格熬不住了，老太太好
像已经得癌症了，共和党总统可以趁机再往最高法院塞一个保守派大法官，这样就彻底
不用看肯尼迪这个骑墙派的脸色了。 |

法律”“修正那个法律”，这我就不能同意，因为高院的这次判决是宣布某个法律违宪
，并没有产生新的法律。
至于你列举的三种逆转最高法院判决的方法，是对的，一条条分析，
第一个，当年克林顿总统签署的DOMA，捍卫家庭婚姻法已经在上一个判决里被宣布违宪
了，就算目前共和党能依仗在国会的多数，通过另一个类似的法案（由于共和党在参议
院不到60席， 这几乎就是不可能的），那么奥巴马也不会签的。
第二个，涉及修宪，几乎没有可操作性。
第三个，还是回到我之前讲的可能性，必须换一个共和党的总统，然后往最高法院里塞
一个保守派大法官，最好是像斯卡利亚，托马斯，阿利托这种极端保守的，然后等着人
家把官司一直打到最高法院，才能有转机，保守估计，这个也要等十年，还要看看能不
能有人击败希拉里，金斯伯格老太太能不能再撑上几年，下一个撑不住的很有可能就是
斯卡利亚了，他也很老了，要是让民主党人做下一任总统，找个自由派来接斯卡利亚的
位置，那最高法院的保守派就彻底变成少数派了。 |
