单独 文章引用 本来就不是用来证明这个的。 “extensively discussed by high
level review articles” 倒是可以，但看样子，你没有这方面的证明。
你要回复这方面，很简单，就2条：找找看你的文章等有没有 “extensively
discussed by high level review articles”； 还有 有没有 媒体报道。
看来是你的律师瞎搞，自己都不清楚怎么证明，乱claim. 这可不是要两封推荐信就能
证明的。
"ability to pay" , 以前有ID提到过 要公司的税表啥的。

具体操作如下：
PartI，criteria evaluation, 首先感谢他承认我claimed 4 条中的 3 条（把这3条做
实）。没有纠结他不承认published material by others, citation不算这一点，3条
足够了
PartII, overall merit,针对他说我"没有足够证据说明the beneficiary is
recognized internationally，承认的三条, 每一条都够了criteria, 但不够说明
outstanding"，我逐条进行了驳斥和加强.
Publications.又找原推荐人之一的一位editor说明他们杂志多了不起，我的工作多好

1月５日打电话问，为什么连biometrics notice都没收到。今天收到USCIS一封信，建
议做Infopass，除此之外，无任何实质内容：

同样受到了rfe。
但是鉴于uscis在rfe中比较明确地指出需要 【The translator must certify that
the translation is complete
and accurate, and that he or she is competent to translate】
所以我又仔细看了一下自己的出生公证。
1 公证书的翻译页的的确确没有任何certification, 翻译页面甚至连公章都没有。（
我不知道自己算不算特例，但是这份公证书是在国内直辖市一个大型公证处办的，让我
颇感意外。）
2 也没有标明翻译人员是谁。更不用说翻译人员certify什么内容了。
总而言之，就是这份翻译，既无法知道是谁翻译的。也没人保证翻译是否准确。
鉴于此，我找了美国当地的一个被翻译协会(ATA)认证的公司重新翻译了一遍。
他们翻译的第一页是一个certification，其实就是“声明自己懂得且可以流利翻译英
语和中文，此翻译版本完整且属实”等等，并且签字。 同时他们也把我的出生公证封
面也翻译了。

本来对于使用AP没有任何疑问，可是刚才律师说这个是个灰色地段，用了AP会影响H1B
status。因为如果是用AP入境，入境的时候海关会给一张新的I-94，上面写的是AOS（
有效期是一年），I-94是我们在美国合法身份的文件。换句话说一旦用AP入境，我们就
成了patrol status了。将来如果要延H1B，就拿不出有效的I-94了。

and no other information could be seen. She said she couldn't access
anything pertaining to my background checks. And she refused to put me
through to a tier 2 officer. I have an infopass session scheduled this week.
Do people usually get more information on background checks through
infopass than over the phone? Or is infopass pretty much the same as calling
USCIS customer service? Thanks. |

USCIS顶头上司DHS的观点是：
1. I-140 beneficiary应该要有合法身份。要不然，让一大批等排期的人蹲移民监，有
违AC21以及大统领的法律文本和讲话精神。State Department发布了第二排期，但是避
而不见。但是没有具体提到140 EAD，只是说道要承认I-140 beneficiary的"legal
standing"。
2. EAD拖拖拉拉，发得太慢，USCIS居然还不承认，然后借口“国家安全”为由，想要
在新的法规中取消90-day的deadline
3. 发RFE犹如浪漫诗人，想发就发，劳民伤财
